Understanding the Federal Hiring Process

While the process may be similar to that in private industry, there are still significant differences due to the many laws, executive orders and regulations that govern federal employment.

Competitive Service versus Excepted Service Positions

There are two types of non-executive positions in the federal government: 1) those that are in the competitive service, and 2) those that are in the excepted service.

  • Competitive Service – Competitive service positions are subject to the civil service laws passed by Congress. The laws help to ensure fair and open competition, recruitment from all segments of society, and selection on the basis of the applicants’ competencies or knowledge, skills, and abilities.
  • Excepted Service – Excepted service positions are defined by statute, by the President, or by the U.S. Office of Personnel Management (OPM) as excepted. These positions are not subject to the appointment, pay and classification rules of the competitive service.

NOTE: DOL agencies have both competitive service and excepted service positions.

Competitive Service

In the competitive service, individuals must go through a competitive hiring process (i.e., competitive examining) before being appointed to a vacant position. This process may include a written test, an evaluation of the individual’s education and experience, an interview, and/or an evaluation of other attributes necessary for successful performance in the position to be filled.

Appointment Methods

  • Merit Promotion – This system is used to consider current and former federal employees for positions on the basis of personal merit. Positions are usually filled through competition with applicants being evaluated and ranked for positions based on their experience, education, skills, and performance record. When a vacancy announcement or job opportunity announcement (JOA) indicates that “Status” candidates are eligible to apply, federal government career employees and career-conditional employees who have served at least 90 days after being placed in a competitive appointment may apply. (To determine whether you are a “career employee” or a “career-conditional employee,” see Job Opportunity Announcement Highlights). Under the Veterans Employment Opportunities Act of 1998 (VEOA) eligible veterans can also apply for positions announced under merit promotion procedures when a DOL agency’s job announcements are open to candidates from outside of its own workforce. These veterans are allowed to compete through the competitive process, however, VEOA candidates are not accorded veterans’ preference as a factor.
  • Applicants applying from outside the federal workforce,
  • Federal employees who do not have competitive service status, or
  • Federal employees with competitive service status.
  • Noncompetitive Action – A noncompetitive action is an appointment to, or placement in a position in the competitive service. This action is not made by selection from an open competitive examination and it is usually based on current or prior federal service. Note - Special non-competitive appointing authorities are established by law or Executive Order. Veterans, persons with disabilities, many current and former Federal employees, and returning Peace Corps volunteers are examples of individuals eligible for noncompetitive appointment.

Locating Job Opportunities

OPM maintains a central database, called USAJOBS, which lists nearly every federal job opening. Available job opportunity announcements (JOAs) provide applicants with information about job qualifications, duties, salary, duty location, benefits and security requirements. The JOA can be used to help you determine if your interests, education, and professional background match the vacant position which could possibly make you a good candidate for the job. A list of common terms is available to assist you in understanding the terms used in job announcements.

You can also find DOL only specific jobs at DOL Jobs . Most jobs in the Department require U.S. citizenship and successful completion of a full background investigation and drug screening.

Job Opportunity Announcement (JOA) Highlights

All JOAs have the same basic sections, although the order, style, and wording vary. Becoming familiar with these sections may help you to zero in on key facts

  • Basic information – At the top of an announcement, you will find the announcement number, position title, grade, and duty location. The name of a person to contact for more information is generally listed at the end of the announcement.
  • Current federal employees serving under a career or career-conditional appointment;
  • Former federal employees with reinstatement eligibility;
  • Current excepted service employees who previously held a permanent appointment in the competitive service;
  • Persons eligible for noncompetitive appointment under special hiring authorities and,
  • Veterans’ preference eligibles or veterans who have been separated from the Armed Forces under honorable conditions after substantially completing at least three consecutive years of active duty (view information on veteran hiring authorities ).
  • Key Requirements – These requirements include statements regarding employment (e.g., U.S. citizenship, clearance level, drug testing, residency requirements, time-in-grade requirements, etc.)
  • General Experience - This broad-based experience provides knowledge, skills and abilities (KSAs) that may be useful in demonstrating your ability to perform the duties of the position that is being filled.
  • Specialized Experience - Experience that has equipped the applicant with the particular knowledge, skills, abilities, and other characteristics to perform successfully the duties of the position and is typically in or related to the work of the position to be filled. .
  • Education - Applicants can qualify for some jobs based solely on education instead of experience. For other jobs, both education and experience are required to qualify; and for other jobs, applicants can qualify based on a combination of both experience and education.
  • Selective Placement Factors are job-related KSAs that are essential for satisfactory performance on the job. Only applicants that meet this requirement as of the closing date of the JOA receive further consideration for the job.
  • Quality Ranking Factors are job-related KSAs and competencies that could be expected to significantly enhance performance in the position but are not essential for satisfactory performance. Qualified candidates are not rated ineligible solely for failure to possess a quality ranking factor.

General Steps in the Hiring and Selection Process

  • Complete Application or Resume – Employee applications should accurately represent the skills and competencies applicable to the position announced. For each past job, give the standard information found in most resumes. Begin with your current position and list all other positions held in chronological order. Specifically, state the job title, starting and ending dates (including month and year), prior employer’s name and address (or write “self-employed,” if that applies), and major duties and accomplishments. Include any positions temporarily held. In addition, show the average number of hours worked per week or simply state “full-time”; salary or wage earned; supervisor’s name, address, and telephone number; and whether you’re most recent supervisor may be contacted. Include the occupational series numbers and the starting and ending grades of the federal government positions held. Include any relevant volunteer experience. Most importantly, describe job duties and accomplishments in a way that demonstrates how you are qualified. Study the JOA and emphasize the parts of your work history that match the qualifications listed there. Remember, human resources specialists might not be familiar with your career field. To help them understand how your experience matches what is required for the vacant position, make sure that you describe your experience in laymen’s terms.   • Apply for the Job – Submit your application by the “closing date” of the JOA. Sometimes, applications only need to be postmarked by the due date. Applications usually, must arrive at their specified destination by either 11:59 PM Eastern Standard Time (EST) or by the close of business. Submit any additional documentation outlined in the JOA that verifies all qualifications such as transcripts, SF-50 Notification of Personnel Action (as proof of eligibility to apply), performance appraisals and/or Veterans’ Form DD-214. If you fail to submit a required document, you may be found ineligible for consideration. Refer to How to Apply for more detailed information.
  • Interview for the Job – The names of the best-qualified candidates are forwarded to the supervisor or hiring official. If you are one of the best-qualified candidates, the supervisor or hiring official may interview you in person or by telephone, which ensures that all applicants receive fair and equal treatment in the hiring process. Interviews are tests designed to measure a variety of competencies important to performance on the job. Interviews may include scenario-based questions that measure selected competencies, e.g., Leading Others, Team Building, Performance and Results Management, Decision-Making and Problem Solving, Oral Communication, Interpersonal Skills, Technical Questions, etc. See Interview Tips for more information.
  • What to Expect Next – The application that you submit will go through many levels of review. First, human resources specialists will screen it to see if you meet the basic eligibility requirements for the position. Then, the human resources specialists or a panel of experts will rate your application according to the additional qualifications listed on the JOA. If your application rates among the best qualified, it will be forwarded to the hiring manager, who will make the final selection. For more information, refer to What to Expect after You Apply .

Vacancies aren’t always planned. Where employee leave and hiring matters concern, vacant positions cannot always be foreseen. Potentially, any business could have a vacant position at any time. This could be because an employee earns a promotion, takes a job elsewhere, is terminated, or has other reasons. Despite no longer paying the employee’s salary, the vacant position they leave behind doesn’t necessarily mean the company is saving money. The cost of vacancy can affect the business—in terms of real dollars, team morale, customer experience, and more. 

In this post, we outline the true impact of a vacant position and its effect on other business areas. 

Vacant Position Meaning

A vacant position, also called a vacancy, is a position that currently has no one serving in it. 

It may be open because someone previously held the job left or the company newly created it. Vacancies may be left open on purpose, like if the company is under a hiring freeze. Alternatively, the vacancy may be undesirable and one the organization actively seeks to fill. 

What are the Cons of Open Positions at Your Company? 

Vacant position costs can vary depending on a variety of factors. Generally, they can be broken down into three primary categories, which we’ll cover here. 

1. The hard costs of a vacant position

When you have a job vacancy, the workload of the individual who left doesn’t go away. It must still be accounted for in some way. This can be done in a number of ways. Either by looking for temporary staffing services, using a contract employee, paying other employees overtime to help make up the work, or else letting the work go unfinished. 

There is also concern about employee turnover costs, which include the additional expenses to source, attract, and hire an employee to fill your vacant position. These costs include every aspect of hiring: marketing the role, onboarding, training, ramp-up time to full productivity, and business error rates resulting from a new hire. 

2. The soft costs of a vacant position

Lost productivity is the most obvious example of a soft vacancy cost, but many others exist. Additional vacant position costs that fall within this category include the negative impacts on employee morale, reduced quality of customer service, and harm to your company’s image or reputation in the eyes of customers and competitors from having a position sit open. 

3. Lost opportunities that result from a vacant position

Finally, we must consider the lost growth opportunities that come from not having a person in a particular role. When productivity is down, it affects your bottom line in several ways. 

Not only does it mean that you’re potentially paying extra money in overtime costs, but you’re also missing out on business and product development opportunities that you can’t take advantage of or explore with strained operations. This, in turn, thwarts your business’ growth and stifles its ability to scale.

What Does COV Stand For?

The cost of vacancy, or COV, is an important metric we can use to determine the actual business impact of open positions in the form of dollars and cents. COV considers not only business impacts like the cost of lost productivity but also the gap between the time talent is needed and the time it takes the recruiting team to supply it. 

How to Calculate Cost-of-Vacancy

The longer a position remains open, the more costly that job vacancy becomes. We can use a few widely accepted methods to evaluate the cost of a vacancy. For these examples, we’ll assume a hypothetical role with a salary of $60,000.

Simple salary multiplier

The simple salary multiplier calculates COV based on the position’s average daily value and the organization’s hiring time.

Here’s the formula:

Average daily value x average time to hire = cost of vacancy

Here’s a hypothetical example. 

Research has shown that an average employee’s organizational value is between one and three times their annual salary. Let’s take the middle ground and say that an employee with a $60,000 salary brings the organization $120,000 in value every year. 

If we divide their value by 260—the average number of working days per year—we get a value of $461.53 per workday. That’s how much we’re losing in value for every day the position sits open. If it’s vacant for 35 days, roughly how long it takes the average company to fill a position, that’s a total vacancy cost of $16,153. 

$461.53 x 35 = $16,153 

Lost revenue

This COV method works well for revenue-generating jobs like salespeople or loan officers. The principle here is that if there is a vacant job in a revenue-generating position, that revenue will be lost if no one is in that slot. 

The formula is as follows:

Average daily revenue x average time to hire = cost of vacancy

Based on metrics like historical data and sales targets, you can make an intelligent estimate of the average yearly revenue generated by any given position. Let’s say the average outside sales rep generates $150,000 in annual revenue for your company. If we divide this by those 260 working days in a year, that’s $596.92 per day or $20,192 total revenue lost for a 35-day vacancy. 

$596.92 x 35 = $20,192

This method can also be applied to non-sales roles by zooming out and looking at the average revenue generated by every employee. To get to this number, you’d divide your total profits for the year by your total number of employees. This gives you a ballpark of how your average worker translates in terms of revenue, which you can then use to calculate the lost revenue per day. 

Budget expenditure lost per employee

We have yet another way to look at vacancy costs if we examine departmental budgets. The principle of this method is that if you don’t have an employee on the job every day, they can’t produce the value reflected in the budget allocated to them. 

Here’s how it’s calculated:

Position budget value x average time to hire = cost of vacancy

To use this method, we first must find the average budget expenditure per employee. We can do this by taking a department’s annual budget and dividing it by the number of employees in the department. 

So, let’s say your marketing department has a total annual budget of $1 million and is staffed by eight people. If we divide $1 million by 8, we find that each employee has a budget value of $125,000 to the department. 

Once again, using 260 working days in a year, we can calculate that the lost budget value for every day an employee is not in a role is $480.76. If the role sits vacant for 35 days, that’s a total cost of $16,826.

$480.76 x 35 = $16,826

Using the various hypothetical examples we outlined above, we can see that our COV is anywhere from $460 to $600 per day—quite a hefty sum. 

Every additional day without a person in the role only multiplies the cost. 

How Time and Position Affects Costs of Vacancy

Thus far, we’ve been using a standard time to hire, typically between four and six weeks, depending on the industry. But some industries and roles take much longer to hire for, impacting your COV. According to Deloitte research, hiring skilled production workers can take 70 days and more than 90 days to recruit highly skilled workers like engineers, researchers, and scientists.

Knowing that a $50,000 position that sits open for a month can result in more than $20,000 in lost revenue is rough. Now, imagine how much more your business will cost to have a vacant scientist or engineering position with a salary surpassing $100,000 and a high contribution to the organization’s output. You’re talking about a significant amount of potential lost productivity and revenue.

In short, the more specialized or advanced the position, the more it costs you, on average, to leave that position vacant. 

Productivity cost considerations

Not all vacancies result in a total loss of productivity—if you hire a temp to tackle some of the work, for example, or split it among other employees. However, you’ll also need to consider the implications of these options. 

A temporary worker will typically have lower productivity than someone who’s been given time to train and onboard into a role fully. If a manager has to absorb some of the additional work, this means some of their time is taken away from higher-priority tasks, which also comes with a cost. Finally, consider the cost of any overtime pay if other regular employees are being tapped to tackle the additional workload.

The most straightforward way to curtail the expense of open positions is to fill them more efficiently. You can do this by streamlining and accelerating your hiring process.

The Path to Reassignment as an Accommodation

Engaging in the interactive process under the Americans with Disabilities Act (ADA) requires navigating a range of reasonable accommodation pathways. Some trails lead to familiar places, like making the workplace accessible, job restructuring, or modifying a schedule. Some paths are bumpy, flanked by twists and turns, and require time and patience to reach the destination, like purchasing equipment, modifying workplace policies, or providing access to leave. Sometimes the process requires navigating an entirely different path than was initially mapped-out, like changing lanes and taking the ramp that leads to reassigning an employee to a vacant position. This accommodation pathway is reasonably well-marked under the ADA, but can still lead those responsible for considering the accommodation to second-guess whether it’s the best route – kind of like when you’re relying on your GPS to get you home, but it generates a different route every time and you’re not sure if you can trust it.

The reassignment path can be trusted when exploring job accommodations under the ADA, provided certain rules are followed. The duty to consider reassignment as a form of reasonable accommodation is clearly articulated in the ADA regulations and enforcement guidance. The title I regulations of the ADA specifically include reassignment as an accommodation, and the Equal Employment Opportunity Commission (EEOC) formal enforcement guidance on Reasonable Accommodation and Undue Hardship Under the ADA notes that this form of accommodation must be considered and provided, when reasonable. Interestingly, even the courts mostly agree with the EEOC position on this accommodation issue. Then why do employers still stumble when they reach the reassignment path as part of the accommodation process?

Likely for a number of reasons, but for one, it probably doesn’t seem logical to give an employee a different job when they can’t perform the essential functions of their current job. But, it’s important to remember that the ADA is meant to facilitate positive employment outcomes for individuals with disabilities. This means that, when a disability prevents an employee from performing the essential job duties of their original position, the possibility of maintaining employment by being placed in a vacant position the employer seeks to fill can lead to a successful employment outcome for all parties. When the interactive process reveals that reassignment is a possible accommodation solution, employers are expected to make that last ditch effort to keep the employee on the path of continued employment.

Reassignment is commonly known as the accommodation of last resort. This is because accommodations that will enable an employee to remain in their current position should, under ordinary circumstances, be considered first. However, this accommodation strategy should not be misinterpreted to mean that it’s only possible to consider reassignment when the search for accommodations in the original position is exhausted. Reassignment can be considered when:

  • there is no reasonable accommodation that will enable an employee with a disability to perform the essential functions of their current position;
  • both the employee and employer agree that an alternative position is a more preferable accommodation solution, in light of the employee’s limitations and ability to perform essential functions, with or without accommodation;
  • an employee is on a leave of absence and their position cannot be held open during the entire leave period without posing an undue hardship, and if there is a vacant position to which the employee can be reassigned to continue the leave; or
  • the location where work is performed causes a work-related barrier due to limitations affecting an employee’s commute, or the need to access specialized healthcare, and there is a vacant position at a different location that meets the employee’s disability-related needs.

What makes reassignment an accommodation under the ADA? The opportunity to be transferred to a new job with the same employer without having to go through the competitive hiring process. An individual with a disability who will be accommodated through reassignment shall not be required to compete for the alternative position. But, while a competitive bid for the vacancy is not required, the individual must be minimally qualified, though not necessarily the best qualified, for any vacant position under consideration, and must be capable of performing the essential functions of the job, with or without accommodation.

The path to reassignment can be bumpy when it’s not clear whose responsibility it is to identify vacant positions, and for what duration the parties will search. This is where it can be useful to have a procedure for processing this type of accommodation request. A procedure can assign organizational responsibility for the job search, and also make clear that the individual is invited to assist in identifying vacancies. The EEOC offers tips for drafting and implementing accommodation procedures, including reassignment procedures, in their guidance on Practical Advice for Drafting and Implementing Reasonable Accommodation Procedures Under Executive Order 13164 . The information in this guidance informs the reasonable accommodation practices of federal government employers, but is a useful resource for other types of employers that must engage in the interactive accommodation process under the ADA.

Employers sometimes ask if an individual who will be reassigned as an accommodation can be expected to formally apply for vacant positions, or to interview for jobs that are selected. The answer to this question probably depends on why the employer wants to require this of someone who is not expected to compete for the job. For example, if the objective of asking the individual interview questions, or to complete an application, is simply to gather information to assess their qualifications and interest in the job, this may be possible. But, if the individual is minimally qualified for the position, they get the job regardless of the interview outcome. An interview may be useful when more than one vacancy has been identified and both the individual and the employer believe the process will present an opportunity to learn more information to determine which position is the best fit.

Upon making the decision to explore reassignment as the accommodation of choice, employers should be mindful of several points. First, reassignment will only be available as an accommodation if a vacant position is available, or will be in the reasonably near future. There is no duty to create a vacancy. The search for vacant positions should include those that are equivalent to the employee’s original position, in terms of pay and status, and does not have to be limited to positions within the employee’s original department or location. When an equivalent vacant position is not available, an individual may be reassigned to a vacant lower level position. In this situation, there is no duty to carry-over the employee’s original rate of pay, unless this is done for others in a similar situation.

Generally, employers are in the best position to know about potential vacancies, but the interactive process is collaborative and so both parties can take part in the job search. The duration of the job search may depend on the size of the employer, but should begin without delay and should be completed in a reasonable period of time. For example, smaller employers may have fewer available positions, and in-turn, may require a shorter duration of time to complete a thorough search. The duration could be days or weeks. Some employers have a policy of searching for a certain number of days (e.g., 30 to 60 days). According to the EEOC, upon the end of a reasonable search period, if no appropriate vacancies have been identified, the employer will have fulfilled its obligation to consider reassignment as an accommodation.

The idea of reassignment as an accommodation raises a number of questions for employers. A lot of ground was covered on this topic in this brief article, but there can be many twists and turns while navigating this path during the interactive process. Finding a job is getting harder even in a strong labor market: ‘It’s just a mess,’ says recruiting pro

The job market might look solid on paper — unemployment is low, job openings are high — but the reality for many Americans on the job hunt tells a different story. 

LinkedIn feeds are crowded with layoff announcements. Mentions of recruiters ghosting job applicants have more than doubled on Glassdoor since before the Covid-19 pandemic. 

"It's frustrating and disorienting — finding a new job has never felt this difficult," says Javier Serrano, who left his job as a software trainer at Parcel Pending by Quadient, a smart locker company, in May, and who has applied to hundreds of jobs since. Serrano had been in his previous role for about eight months.

Some companies have asked him to go through several rounds of interviews and then disappeared; others sent him take-home tests or asked him to record video responses to AI-generated questions. He has not received any offers.

Serrano, 50, says he initially expected to find a new job within six months, but now, he's expecting to be out of work for close to a year. He recently applied for a job delivering groceries for a store near his house in Orlando to help cover his living expenses.

"I'm optimistic that things will work out," says Serrano. "I just think the numbers are underselling how hard it is for job seekers right now."

Economists and recruiters say lingering expectations from the "great resignation" and businesses' fears about an imminent recession could be to blame for job seekers' malaise. 

Jobseekers have whiplash from the 'great resignation'

A major reason more people are burned out from searching for a new job could be due to unrealistic or outdated expectations.

"How people feel about the job market is informed by their recent experiences with the job market," Glassdoor lead economist Daniel Zhao recently told CNBC. "In 2021 and 2022, there were labor shortages, so [employers] were offering all kinds of perks and benefits to try to get people in the door. So even if 2024 is shaping up to be a relatively healthy labor market by recent comparison, it doesn't feel quite as strong."

Nearly 70% of job seekers say their current search is more difficult than their last one, according to a recent survey of more than 1,500 candidates from the staffing firm Aerotek.

"If you want to get hired in this environment, you need to have a different mindset than you did in 2021," says Bert Bean, CEO of the staffing firm Insight Global. "What some job seekers aren't realizing is that employers are a lot more cost-conscious and less willing to make concessions with pay or remote work than they were two years ago." 

High inflation and the threat of a potential downturn are casting a dark shadow over the labor market 

For much of 2023, companies felt like a recession was lurking around the corner and pulled back on hiring as a result — those fears aren't gone yet, says Zhao. 

"Business leaders are still concerned that a recession is possible, even if it's not 100% certain," he tells CNBC Make It . "They don't want to overhire into a recession and then have to lay people off." 

Dan Kaplan, a senior client partner at Korn Ferry, one of the world's largest hiring and recruiting firms, likens companies' current hiring approach to driving in a hailstorm. 

"No one can figure out what's ahead, which means you have to make more decisions blindly," he explains. "Normally, economists will predict a tough market for two of three quarters and there's a light at the end of the tunnel, but this time it's been almost 24 months of predictions of doom and gloom."

That uncertainty, he adds, is causing "a lot of fatigue" in boardrooms across the U.S.

As more companies pause hiring, they're trimming their talent acquisition teams, too, says Kaplan, which means there are fewer people to manage job postings and respond to applicants, further exacerbating confusion in the job market.

For employers to feel more confident about the economy and expand hiring, interest rates need to come down, says Kaplan. Until then, he says companies are in a "wait and see" period. 

"The prevailing sentiment is, 'let's talk in Q2,' but that could easily be pushed to Q3 or Q4," Kaplan adds. "It's a frustrating time for candidates and an equally frustrating time for businesses who can't hire the talent they need … it's just a mess."

It's still a good time to find a new, better job — in some industries

Despite the labor market's current challenges, there are still plenty of opportunities for people who want a new and better job. 

The labor market posted 9 million openings in December, and there are still roughly 1.4 open jobs for every unemployed person. 

Even though tech and media companies are slashing jobs, Bean says other industries like government, health care and construction have increased hiring in recent months, offering more stable positions that could prove resilient in a potential recession. 

Kaplan agrees, calling these industries a "safer bet" for job seekers, even if some, like health care, construction and manufacturing are still recovering the jobs they lost during the pandemic.

The smartest approach jobseekers can take right now, he adds, is to be persistent, and stay the course. "If sending in 400 applications hasn't landed you an interview, submit 600, or use your free time learning a new technical skill you can add to your resume," he says. "Things won't stay this hard forever."

FAQs on the Vacancies Act

The Federal Vacancies Reform Act of 1998 establishes requirements for temporarily filling vacant positions in Executive Branch agencies that require presidential appointment and Senate confirmation. These are commonly referred to as PAS positions. This act identifies who may temporarily serve, for how long, and what happens when no one is serving under the act and the PAS position is vacant.

The Vacancies Act applies to presidentially appointed, Senate confirmed positions in Executive Branch agencies, including Executive Branch departments, government corporations, independent establishments, and the Executive Office of the President. (5 U.S.C. §§ 101, 103–105, 3345(a).) However, the Vacancies Act expressly does not apply to: (1) positions at GAO; (2) members of boards, commissions, or similar entities composed of multiple members that govern independent establishments or government corporations; (3) members of the Federal Energy Regulatory Commission and Surface Transportation Board; and (4) judges appointed under Article I of the Constitution. (5 U.S.C. §§ 3345(a), 3349c.) Please note that even if a position is covered, there are certain situations where the Vacancies Act does not apply (see question 9). 

The Vacancies Act directs that the first assistant to the vacant office is the default acting officer. However, the act also authorizes the President to direct a presidentially appointed, Senate confirmed officer or a senior agency employee meeting certain criteria to serve as the acting officer. (5 U.S.C. § 3345(a).) 

The Vacancies Act does not define the term “first assistant.” For certain covered positions, the first assistant is designated by statute (e.g . , 6 U.S.C § 113(a)(1)(A); 28 U.S.C. § 508(a)). For other covered positions, agencies may, prior to a vacancy occurring, designate first assistant positions through various means, including regulations, agency orders, agency directives, or position descriptions. (B-332995, Aug. 2, 2021.)

No. An individual who becomes first assistant after a vacancy occurs in a covered position may serve as the acting officer unless: (1) the time period for acting service has expired; or (2) the individual is nominated for the covered position (subject to some exceptions that are described in the answer to question 6). (5 U.S.C. §§ 3345(a)(1), 3345(b), 3346; B-332995, Aug. 2, 2021; GAO, Changed Interpretation of Requirements Related to First Assistants Under the Federal Vacancies Reform Act of 1998 , GAO-02-272R (Washington, D.C.: Dec. 7, 2001).)

In general, the nominee to a covered position may not serve as the acting officer under the Vacancies Act. (5 U.S.C. § 3345(b)(1); NLRB v. SW General, Inc. , 137 S. Ct. 929 (2017).) But the act includes several exceptions. First, the nominee may serve as acting officer if they served as first assistant to the position for a minimum period of time prior to the vacancy occurring. (5 U.S.C. § 3345(b)(1)(A).) Second, the nominee may act if: (1) they are the first assistant; (2) the first assistant position is a presidentially appointed, Senate confirmed position; and (3) the nominee was appointed by the President and confirmed by the Senate to that position. (5 U.S.C. § 3345(b)(2).) Finally, the President may direct a nominee to act if they previously held the covered position and the President nominated them for reappointment to an additional term without a break in service. (5 U.S.C. § 3345(c)(1).)

The Vacancies Act includes several time limitations on acting service in covered positions when vacancies are not caused by sickness. If no one has been nominated to the position, an acting officer may serve in the position for no longer than 210 days beginning on the date of the vacancy. (5 U.S.C. § 3346(a)(1).) However, for any vacant positions that exist during the 60-day period beginning on a transitional Presidential inauguration day, an acting officer may serve in the position for no longer than 300 days beginning on the inauguration day or the date of the vacancy, whichever is later. (5 U.S.C. § 3349a.)

If there is a first or second nomination for the position, an acting officer (who is not the nominee or is the nominee and meets certain exceptions) may serve while the nomination is pending in the Senate. (5 U.S.C. § 3346(a)(2).) If the nomination is rejected or returned by the Senate or withdrawn by the President, an acting officer may serve for no longer than 210 days after the date of the rejection, return, or withdrawal. (5 U.S.C. § 3346(b).) These additional periods of acting service only apply to the first and second nominations. Further acting service is not permitted after 210 days following the rejection, return, or withdrawal of a second nomination, even if a third nomination is made. (5 U.S.C. § 3346.)

The Vacancies Act requires that covered positions must remain vacant unless an acting officer is serving in accordance with the requirements of the act. (5 U.S.C. § 3348(b).) When a position is vacant, only the head of the Executive Branch agency (unless the vacant position is the agency head) may perform the functions and duties that are required by statute or regulation to be performed by such position. (5 U.S.C. § 3348(a)–(b).) The Vacancies Act states that if an individual who is neither the agency head nor acting in accordance with the act performs such functions or duties, those actions have no force and effect and may not be ratified. (5 U.S.C. § 3348(d).) However, some positions are excluded from these restrictions.  (5 U.S.C. § 3348(e).)

The Vacancies Act is the exclusive means for temporarily filling covered positions unless: (1) there is a statutory provision that either expressly designates an acting officer or authorizes the President, court, or Executive Branch department head to designate an acting officer; or (2) the President appoints an individual while the Senate is in recess in accordance with Article II, Section 2, Clause 3 of the Constitution. (5 U.S.C. §§ 3347.)

GAO receives and records the information that agencies report to the Comptroller General under the act. GAO’s Office of the General Counsel performs outreach to agencies to promote compliance with the act, notifies Congress of violations of the act’s reporting requirements, reports violations of the act’s time limitations to the President and Congress, and issues decisions on agency compliance with the act when requested by Congress.

CAPE TOWN - Parliament says it's considering the names of 44 candidates to be the next deputy Public Protector. 

The position has been vacant since the former deputy Public Protector, Kholeka Gcaleka, was appointed as Public Protector in November. 

The public is now being invited to make their comments on the applicants and nominations, several of whom are taking a second stab at the job. 

Gcaleka is the only deputy public protector in the country’s history to also be appointed Public Protector. 

Although she served in the job for less than four years, one of those in an acting capacity as Public Protector, the deputy Public Protector is ultimately appointed by the president for a seven-year term, which can be extended for a second term. 

The chosen candidate stands to earn a salary of R1.9 million a year. 

Among the applicants and nominations received by Parliament are at least 17 advocates. 

Some of the candidates also applied for this job before, when they lost out to Gcaleka in 2019. 

Others, like North West University law professor, Boitumelo Mmusinyane, also applied for the Public Protector’s job just last year, also losing out to Gcaleka after an interview. 

The Public Protector’s executive director for investigations, Ponatshego Mogaladi, who appeared before the impeachment inquiry of former Public Protector, Busisiwe Mkwebane, has accepted a nomination for the job. 

Chairperson of the Justice committee, Bulelani Magwanishe, said that the shortlisted candidates would all be subjected to a screening process. 

The public can access the profiles of the nominations and applications on Parliament’s website for comment, which the justice committee will consider before shortlisting candidates for interviews.

Education, Qualifications & Qualifications & another knowledge

  • ·         BA degree in psychology, counseling, sociology, or social work from a recognized institution.
  • ·         3 years of relevant experience with the first degree and 2 years of relevant experience plus post graduate degree
  • ·         Experience on implementing or leading Sexual and reproductive health, protection and/or Gender focused projects in emergency and/or GBV case management and services to GBV survivors
  • ·         Experience on working with internally displaced people.
  • ·         Demonstrated technical expertise in protection monitoring and responses for IDPs, and host communities.
  • ·         Fluency in Somali and English language is required.
  •   Desirable Qualities, Skill, and Competences
  • ·         Understanding of financial requirements of projects and ability to prepare and manage budgets.
  • ·         Good level IT skills and computer literacy; proficiency in Kobo and other data collection/analysis tools

  • ·         At least 5 years’ work experience in a similar field (and 3 years in managerial position) in INGOs
  • ·         Fluency in Somali and English language is required
  • ·         Very good understanding of the pastoralist context and their livelihood systems
  • ·         Good analytical skills
  • ·         Good level IT skills (MS Office) and computer literacy

Position 6:Project Finance and Administration Officer

  • BA degree in Accounting and Finance
  • A minimum of  Five years’ work experience  in a similar field
  • Proven experience in finance
  • Experience in using accountancy software packages
  • Strong computer skills in MS Office programs
  • Knowledge of managing multi-donor fund
  • Good command of English
  • Good computer skills
  • Diligent and trustworthy person
  • Strong Analytical skills

Standard function description:

  •   Handle bookkeeping of the HEKS/EPER Project office
  •   Process financial data on computer and, working mainly independently, provide end-of-month closing accounts and reports

Keep applying for 'reach jobs,' say experts, as you might actually land one of them

Even in a tough economy, employers need qualified candidates to fill their open roles.

Every person seeking a job has read a description of an opportunity that sounded like the career of a lifetime.

No matter what field the job is in — everything from social media to marketing to law to business to education to advertising to tech and artificial intelligence — the best positions can seem elusive and swoon-worthy. 

And while you may think that applying to these types of "reach jobs" is pointless, job experts say you never know what a recruiter could be looking for — that person could be you.

Two job experts shared with FOX Business their insights into reach jobs today, and why even in a tough economy, applicants might consider applying for them.

Here's why. 

Applying to a dream job can open doors

If you are interested in a particular industry or company and you follow those entities on social media, check their career site for any open roles.

"If an opening for your dream role appears and you have at least some of the qualifications for it, take that opportunity to apply and see where it leads," Michael Steinitz, senior executive director of professional talent solutions at Robert Half, who’s based in Washington, D.C., told Fox Business. 

"Though it might feel outside your comfort zone, you never know what qualifications a company is emphasizing and how you might fit in with their culture."

And if that exact role isn’t a fit, there could be other jobs in the pipeline . The only way to know about them is to get into the company’s job database. 

Another plus in your favor: Human resources and hiring managers may consider certain skills of yours to be highly desirable, even if those skills are not mentioned in a job description. 

"It’s not impossible for applicants to be offered a job even if they don’t match the exact qualifications for the role," Steinitz said.

"Depending on the industry and position, hiring managers can be open to finding an employee whose skills can be developed through training."

Employers need experience that’s diverse and interesting

Although the dream job may not align perfectly with your skillset and experience, it may still be worth applying in order to advance your career goals , experts say. 

"The demand for talent is high and companies are still having trouble finding the talent they need," Steinitz said. "It can be difficult to find individuals who check every box."

When that happens, the applicant pools broaden and hiring managers might look for people who can contribute more than just technical skills, he indicated. 

"Sometimes companies look for people with a different scope of experience to bring in fresh perspective and attitude."

"For example, they might prioritize hiring someone with the right soft skills or someone they see fitting in well with their culture," said Steinitz.

Also, a priority for companies now is creating a more diverse and creative team, according to many reports.

"While technical skills can always be taught, sometimes companies are looking for people with a different scope of experience to bring in fresh perspective and attitude," he said.

Tweaking your resume and cover letter can help

If you’re hoping to score an interview for that dream job of yours, it’s wise to update your resume to ensure that it’s polished and customized for the role.

"While it might not be necessary to build your resume from scratch for every job application, it’s important to tailor it so that you underscore your interest in a specific job and company," Steinitz told Fox Business.

As for the cover letter, that's where applicants should promote themselves, describe their ambition and express enthusiasm for a new role and a new company, Steinitz pointed out.

"It's good to tie in the elements of the job that match their unique skills and experiences," he also said.

To that point, emphasize the areas where you’ve excelled, what would make your contribution unique and include examples to highlight your talents, he said.

Networking can come in handy for that elusive job 

If you happen to have a contact who knows someone at a desired company, it’s acceptable to reach out to that person.

You can share your interest in the company and a potential role — and see if they're open to making an introduction.

Alex Pisani, chief legal officer with Engage PEO based in Hollywood, Florida, said in today’s dynamic employment landscape, the ability to showcase versatility and resilience is key for those seeking to land a dream job.

If you don’t have a shared connection with someone you’d really like to connect with, be sure your outreach includes a quick introduction of yourself and a specific note explaining why you’d like to connect, Steinitz with Robert Half suggested.

"This can take some extra effort, but it can increase your chances of breaking the ice with a new contact," he said.

Always keep your requests professional and don’t be overbearing. 

If the person doesn't respond or does not wish to assist, respect those boundaries. And if you do snag an interview, use the opportunity to shine and show those you meet why you’re the best candidate. 

"Once presented with an opportunity, candidates should use the interview process to demonstrate certain practical skills , such as problem-solving, clear communication and technical know-how," Pisani with Engage PEO told Fox Business. 

"This can help bridge any potential gaps between required job qualifications and professional experience."

B e realistic about your chances

If the job description says 10 years of experience and someone has just one year — that’s likely out of reach, so keep your dream job expectations reasonable. 

"Employers are generally optimistic about hiring in 2024."

"Applicants should take the time to evaluate their career accomplishments and see if they’re able to make a compelling case for a role by highlighting past results, transferable skills and a willingness to learn," said Steinitz with Robert Half.

Regarding today's tough job market, Pisani with Engage PEO noted, "Both employers and candidates should be aware of market conditions and job demand in their industry. This means that employers should give appropriate weight to transferable skills when considering candidates — and applicants should remain flexible throughout the hiring process."

And Steinitz with Robert Half said, "Despite a complex market , Robert Half's latest Demand for Skilled Talent report shows that job openings remain high … Almost 60% of the surveyed hiring managers indicated they are also planning on hiring for new roles in the first half of 2024."

He added that while "needs differ among each industry … our research shows that employers are generally optimistic about hiring in 2024 as they anticipate company growth and resuming projects that were put on hold."
