Florida Highway Patrol said a driver in a stolen vehicle was taken into custody in Orange County after a pursuit on Thursday.

Around 6:50 a.m., a trooper observed a car ahead of them without tail lights "aggressively switching lanes," according to an arrest report.

FHP said the vehicle hit the front right of the trooper's patrol car when swerving into a lane on State Road 528 near University Boulevard.

Troopers tried to conduct a traffic stop, but the driver, 28-year-old Kais Kaheel, fled. According to FHP, Kaheel crashed and damaged another vehicle near U.S. Highway 192 and Siesta Lago Drive.

Troopers said Kaheel also crashed into a fence located near a ramp to I-4 from U.S. 192, got out of the car and ran.

Kaheel was arrested on several charges, including grand theft of a motor vehicle, leaving the scene of a crash, fleeing and eluding officers and operating a vehicle with a revoked driver's license.

Florida deputy fires weapon after mistaking sound of acorn hitting patrol car for gunshot

A Florida deputy is seen firing his weapon repeatedly at his patrol vehicle after mistaking the sound of an acorn hitting the roof of the car for a muffled gunshot, according to video released alongside a sheriff's office investigation.

Newly released body camera footage of the November 2023 incident shows the dramatic moments the Okaloosa County deputy shot at his patrol vehicle while a handcuffed suspect was inside.

"I'm hit! I'm hit!" the deputy, Jesse Hernandez, can be heard yelling, though no one was shooting at him.

As he stumbled to the ground, Hernandez yelled "Shots fired!" four times, according to the video and an internal investigation conducted by by the Okaloosa County Sheriff's Office of Professional Standards. He then opens fire on his vehicle.

A sergeant with the sheriff's office also fired her weapon multiple times at the patrol vehicle, believing Hernandez was in danger, according to the report .

After the sergeant asked if he was OK, Hernandez responded, "I'm good, I feel weird but I'm good," the footage shows.

The two had responded to a report of a stolen vehicle at a residence near Fort Walton Beach on Nov. 12, 2023, according to the report. A woman reported that her boyfriend was refusing to return her vehicle and had been calling and texting her threats, including "what appeared to be a firearm suppressor pointing at the dash of the victim's vehicle," the sheriff's office said in a news release.

The boyfriend was detained, searched, handcuffed and placed in the rear of Hernandez's patrol vehicle, the sheriff's office said.

While approaching the vehicle to conduct another search, Hernandez told investigators that he heard what he believed to be a "suppressed weapon off to the side," according to the report.

"At the same time, I felt an impact on my right side, like upper torso area," he said in an interview on Nov. 15, 2023, according to the report.

Hernandez and the sergeant both fired their weapons at the patrol car until their firearms were emptied, according to the report.

The boyfriend was uninjured and no weapon was located, the sheriff's office said.

"The audible sound Deputy Hernandez reported can be heard on body cam video and witnesses also attested they heard the sound they thought could have been a muffled gunshot," the sheriff's office said.

During the interview, investigators informed Hernandez that what he heard was an acorn, according to the report. Asked if what he thought he heard was actually the noise of the acorn striking the roof of his patrol vehicle, Hernandez responded, "I'm not gonna say no," according to the report.

"What I heard sounded what I think would be louder than an acorn hitting the roof of the car, but there's obviously an acorn hitting the roof of the car," he said, according to the report.

The investigation determined that Hernandez's use of force was "not objectively reasonable," the sheriff's office said. He resigned during the course of the investigation on Dec. 4, 2023, nearly a year after joining the force, according to the sheriff's office.

ABC News has reached out to Hernandez for comment.

The sergeant's use of force was found to be "objectively reasonable" and she was exonerated, the sheriff's office said.

Both were cleared of any criminal wrongdoing, according to Okaloosa County Sheriff Eric Aden.

Aden said they "understand this situation was traumatic" for the man detained in the patrol vehicle and are "thankful" he wasn't injured. The office has incorporated this incident into their training "to try to ensure nothing similar happens again," the sheriff said.

"Though [Hernandez's] actions were ultimately not warranted, we do believe he felt his life was in immediate peril and his response was based off the totality of circumstances surrounding this fear," Aden said in a statement. "Just as we have an obligation to protect our officers so they can go home safely to their families, law enforcement has the same obligation to any citizen being investigated for a crime."

NYPD detectives and Megan McDonald family call for FBI to investigate Orange County DA

Within days of a USA Today Network New York series that revealed a blistering State Police report taking Orange County District Attorney David M. Hoovler to task for his alleged actions in the Megan McDonald murder investigation, the NYPD's Detectives' Endowment Association called for the FBI and New York's Attorney General to investigate Hoovler.

Paul DiGiacomo, president of the Detectives' Endowment Association, was flanked by members of his group and by Karen and James Whalen, the sister and brother-in-law of Megan McDonald, at the hastily called news conference.

"I've been a detective for over 40 years, and there's something that we go by, and that's gut instinct a lot," DiGiacomo said. "And this case smells. There were things done that were unethical, things done that were wrong, things done that should be investigated by the FBI and the attorney general to bring to light the corruption in that office in regards to this homicide case."

Megan McDonald's father, Dennis, was an NYPD detective who served 20 years before retiring in 2000. He died of a heart attack in 2002, a year before his daughter's murder. His fellow detectives have stood by the family, offering a reward for information leading to a conviction.

McDonald's body was found in an Orange County field in March 2003. For 20 years, State Police investigators sought her killer. In April 2023, a month after the 20th anniversary of the murder, they arrested Edward Holley, Megan's former boyfriend, and charged him with second-degree murder.

Within days of the arrest, Hoovler recused himself and his office from the case, and punted the preliminary hearing, permitting Holley to go free. Veteran Westchester prosecutor Julia Cornachio was named special prosecutor.

"One of the reasons it took 20 years to bring this case to the point it is now, was that the current district attorney, David Hoovler, was once the defense attorney who represented one of the perpetrators in this homicide," DiGiacomo said.

"The DEA is now calling on the FBI and the attorney general to open an investigation into the district attorney, David Hoovler, to find out why he stood in the way of arresting Holley to begin with, and he stood in the way of bringing justice for that beautiful girl, Megan McDonald," he added.

Hoovler, as a defense attorney, in 2008 sought a manslaughter plea deal for his client, whom he later identified as Andre Thurston. Thurston died in 2010 from a drug overdose, days after the seventh anniversary of Megan McDonald's murder.

Hoovler denies the conclusion drawn in the internal State Police report, that he tampered with the investigation because of his role representing Thurston.

"Any suggestion that I, or anyone in my office, did anything to 'tamper with,' or in some fashion compromise the investigation into Ms. McDonald's death is as categorically false as it is offensive," he said.

Last week, Cornachio was able to secure an indictment of Holley, who was arraigned on Feb. 2 and is now being held in Orange County jail on a second-degree murder charge. He has declared his innocence.

Karen Whalen, the family's spokesperson, along with her husband, said: "We are just so emotional about standing here with Paul DiGiacomo and the DEA and how they have been by our side with everything that we've needed with my dad not being here. They have just been our rock to stand with.

"We are here as Megan's family now, joining the DEA and Paul to call for an investigation into David Hoovler and his actions. Only after an arrest was made and after we retained an attorney, John Beatty, did David Hoover call a meeting where he announced his recusal."

That meeting took place on April 25, 2023, five days after the arrest and a day before Holley went free. The meeting was so full of Hoovler assistants that there wasn't enough room in his office to hold the meeting. Instead, Hoovler told the McDonalds he wouldn't be taking the case to the grand jury — in the grand jury room.

"At this meeting, he brought in seven of his staff members," Karen Whalen said. "We found him to be untruthful and evasive in his responses to us. In this meeting, his story continued to change. We asked him repeatedly for clarification. We asked him repeatedly for answers. And we still can't understand how David Hoover could act as a defense attorney for someone involved in my sister's case and turn around and be the district attorney."

Beatty then took to the podium, saying Hoovler has not been truthful or forthcoming to date.

"If the governor's office or the attorney general or the FBI would come to our aid in trying to get answers in this case, both for this family who's been so injured, but also for the taxpayers of Orange County," Beatty said.

Hoovler recused himself in other cases, Beatty said. "The question is why didn't he recuse himself in this case?"

James Whalen spoke of the meeting in the jury room on April 25, 2023, when Hoovler, joined by a gaggle of his senior staff and investigators, broke the news that he would finally recuse himself.

"We join in the DEA's call for investigation of District Attorney David Hoover and our opinion is based solely on the contents of our meeting with D.A. Hoover and the individuals that he brought to that meeting, " James Whalen said. It was at that meeting, Whalen said, "where he surprised us with the announcement that he was going to recuse himself and constantly shifted his story."

Karen Whalen said she's looking forward to putting the case behind her.

"The whole point of this for us, for our family, our entire goal is to get my sister back," she said. "It's to stop talking about how she died and not remember her that way, but to remember all the love and her smile and laugh and everything that she brought good to our family and talk about that again. At the end of this, that is our goal is to never talk about this again and just move forward with our happy, warm memories of her."

JACKSONVILLE, Fla. – The funeral director at the center of an investigation involving accusations of stealing, mishandling remains and abandoning a Northside mortuary was moved to the Duval County jail after his Friday arrest in Orange County.

Elliott Graham, 49, was wanted and accused of stealing, giving families the wrong ashes and abandoning a mortuary with bodies inside.

Investigators were scouring the Marion Graham Mortuaries on Gandy Street for days as they searched the premises. It was unclear what investigators found, but there was enough evidence for the Department of Financial Services to obtain an arrest warrant.

Graham was arrested on Feb. 2 .

According to an arrest report obtained by News4JAX, on Jan. 30, investigators discovered three bodies in various stages of decomposition found in cadaver bags in the funeral home. Investigators said the bodies were stored in a non-refrigerated or non-air-conditioned facility for an extended time.

The report said the bags were infested with bugs.

Nairobia Durden said her family received an unexpected call from state investigators who told them that their grandmother’s body was one of the three bodies found in the mortuary.

“While we are relieved that Elliot has been captured and is facing charges, the damage to my family’s sense of closure and peace can’t be repaired. My grandmother deserved dignity and respect, and the fact that she was subjected to such negligence and deception is truly heartbreaking,” Nairobia said on Thursday. “This situation has left us to deal with a whirlwind of emotions, ranging from disbelief to anger to sadness. The violation of trust and damage of the final memories we had of my granny is simply unfathomable. No family should ever have to endure such a horrific betrayal during their time of mourning.”

Some rooms in the funeral home were in disarray, leading investigators to believe Graham was living at the home.

Investigators repeatedly tried to contact Graham, but the report said, he kept putting them off, stating that he was “going through personal matters and unavailable.”

The report said investigators believed Graham had no intentions of returning to the funeral home and that he “abandoned the decedents without regard to dignity or respect.”

Several Jacksonville families have spoken to News4JAX about how they trusted Graham to take care of their loved ones but experienced a painful event during a time of mourning.

Graham faces charges including grand theft and improper preservation of a body. He is being held on a $100,000 bond.

Bodies of missing Tennessee deputy and woman who had been detained recovered, officials say

MEIGS COUNTY, Tenn. -- The body of a Tennessee deputy was found Thursday after he went missing following his first-ever arrest. His patrol vehicle and the body of the woman he arrested were also recovered from a river, authorities said.

Meigs County Deputy Robert "R.J." Leonard's remains were being taken to a medical examiner's office.

Leonard's vehicle was pulled from the Tennessee River earlier on Thursday, in an area on the border of Meigs and Hamilton counties, officials said.

A body believed to be that of the female arrestee has been recovered from the backseat of the vehicle, according to Hamilton County Sheriff Austin Garrett.

"We always hope that it's a rescue, so we always hold out that hope. But we also have to face the facts that are in front of us," Garrett said at a press briefing Thursday afternoon. "We won't lose hope that we could still recover him."

Authorities are working to confirm the identity of the person recovered from the backseat, though believe it to be the arrestee, according to Meigs County District Attorney Russell Johnson.

Leonard had responded to a report of a man and woman fighting on a bridge shortly before 10 p.m. local time Wednesday and had taken the woman into custody, according to Johnson. He was driving to the county jail when the sheriff's office lost communication with him and he failed to respond to a status check, Johnson said.

One of the deputy's last communications was a text to his wife that said, "Arrest," Johnson said.

"His wife texted back and said, 'That's good' or 'That's great,'" Garrett said at a press briefing earlier on Thursday. "We know that his phone did not evidently receive that text."

At nearly the same time, Leonard also made a radio communication to dispatch, shortly after 10 p.m., Johnson said.

"Dispatch couldn't tell what he was saying," he said. "We think he was saying, 'Water.'"

The search led authorities to a landing near the bridge at the Tennessee River, Johnson said.

"They triangulated the last position of his phone and the Life360 that his wife has attached to his phone and it appears that they're almost in the same location," Johnson said.

A vehicle was located Thursday morning in the river. It was upside down with the wheels up, filled with mud, and the driver-side window was down, Johnson said. The license plate confirmed it to be Leonard's patrol car, according to Johnson.

Officials said the landing can be treacherous, especially for those not from the rural area. A woman went into the water at the same location several weeks ago and was rescued and survived, Johnson said.

Multiple agencies will investigate how the vehicle ended up in the water. However, Johnson noted that the deputy, a native of New York, appeared to be texting and radioing while driving in a poorly lit area he was unfamiliar with.

"We're operating under the theory that it was an accident -- he missed his turn, he wasn't familiar and he was doing other things that may have caused him to go into the water," Johnson said at the Thursday afternoon press briefing.

Leonard joined the force after graduating from the training academy in December, according to Meigs County Sheriff Jackie Melton. He was on the night shift and was doing a "real good job," Melton said.

Leonard lived in nearby Roane County with his wife and three children, officials said.

"It's a hard time for us here," Meigs County Chief Deputy Brian Malone said at the press briefing, choking up. "It's something that we don't ever deal with here in Meigs County."

"Deputy Leonard had only been here for a couple months, but he'd become part of our family," he said.

A winter storm anticipated to hit Los Angeles County by Sunday night, Feb. 18, will bring with it the possibility of thunderstorms, flooding and wind gusts throughout Southern California until midway through next week, forecasters said.

A flood watch has been issued for most of the region through Tuesday night, and a winter weather advisory was issued for higher elevations. High surf is anticipated along the coast.

Parts of Los Angeles County, including Pasadena and the San Fernando Valley, could see nearly three inches of rain from Sunday night through Wednesday, according to projections from the National Weather Service. Others in the southern portion of the county could see less than two inches.

The storm system has a slight possibility of starting in Los Angeles County with light rain as early as Saturday night, NWS meteorologist David Gomberg said.

“Because of that rainfall last week … it’s not going to take much rain to cause significant problems over the next few days,” Gomberg said during a Saturday afternoon presentation.

The heaviest rainfall was anticipated in Los Angeles County Monday night and Tuesday night, with peak rainfall rates between one-half inch and one inch per hour, Gomberg said. Moderate rain was anticipated to start Sunday night.

“It’s a more convective system with this and what that means, basically, is you could get some high-intensity rainfall rates,” Gomberg said. “Think of it as higher intensity, shorter duration rainfall.”

There was a 10% to 20% chance of isolated thunderstorms Sunday night through Tuesday, forecasters said.

The storm would then move into Orange County and the Inland Empire, though it looked like the system had been “slowing down a bit,” NWS meteorologist Elizabeth Adams said.

Most areas in Orange County were projected to receive one-and-a-half to two inches through Wednesday, while areas of the Inland Empire were projected to see less, Adams said.

“The ground is pretty saturated from the last few weeks so there will be concerns due to runoff that could result in flooding, especially in low lying areas,” Adams said.

Orange County could begin seeing light rain Monday, but Adams said the heaviest rainfall was projected for Tuesday with lingering rain chances likely through Wednesday morning.

Snow accumulations could get as low as 5,500 feet in Los Angeles County mountain ranges and as low as 6,000 feet in Orange County and the Inland Empire, forecasters said. Most of the snow accumulations would remain above 7,000 feet.

A high surf advisory was in effect for the Orange County coast from 4 p.m. Saturday to 10 p.m. Tuesday. A winter weather advisory was scheduled to be in effect for the San Bernardino and Riverside county mountains from Tuesday morning to Wednesday morning.

A coastal flood advisory would be in effect for L.A. County beaches from Sunday morning to 9 a.m. Tuesday morning, according to NWS.

Peak wind gusts could reach 40 mph in L.A. County valley areas and up to 60 mph in the foothills and mountains, Gomberg said, adding that with the saturated soils, there was the possibility for downed trees.

Strong winds were not expected in Orange County and the Inland Empire, but breezy conditions Monday afternoon into Tuesday could make the region feel colder.

The storm’s impacts would likely be greater in areas northwest of L.A. County, including San Luis Obispo, Santa Barbara and Ventura counties, Gomberg said.

“It’s not looking like it’s going to be quite as heavy as the past few storms,” Adams said, “but people should stay vigilant and updated.”
