If you have a combo card (single card acting as EAD and AP)

Write "A-number" and mention "Application for I-765 and I-131 (combo card)" and put documents in the same envelope.

If you have separate cards and renewing one or both of them

Write "A-number" and "I-765 application" or "I-131 application" based on what you are applying for and use separate envelopes for each application type.

If you are applying for a spouse/kids, DO NOT put applications of all individuals in one envelope and make different envelopes per individual applicant.

Don't staple documents, use binder clip (smallest 0.6-inch clip) or paper clip .

EAD/AP Renewal FAQ

You can do it yourself, you don't need attorney for filing. But if your company is offering attorney help, then go for that.

If you want to renew your EAD/AP combo card then you should file both applications simultaneously and no more than 180 days before the expiry date on card

Now·a·days card is given with 2 year validity, but previously it was 1 year.

EAD/AP is a combo card issued by USCIS. It combines an Employment Authorization Document (also known as a work permit or EAD) with Advance Parole permission (allowing you to travel and return to the U.S. without abandoning your green card application-in-progress.)

Attach 2 photos with EAD application and 2 photos with AP applications, so total 4 photos. Sometime EAD and AP applications are processed at different time and by different people.

How to Renew an Employment Authorization Document

Foreign nationals who are temporarily residing in the U.S. and are eligible to work may file an application for a work permit and receive an EAD (Employment Authorization Document) . Permanent residents or Green Card holders don't require an EAD to work.

One of the benefits of having a Green Card is the ability to work without a permit. Generally, EADs are valid between 1-2 years—the expiration date of your work permit is printed on the front of your card. If you have an EAD, you should monitor its expiration date and renew it before it expires. If you let your EAD expire your work authorization could be revoked. You can submit your application for renewal starting at 120 days before your EAD’s expiration date.

Submitting an Application for Renewal

To renew an EAD you are required to complete and submit form I-765. The EAD processing time is approximately 90 days from the date of the application. Filling out Form I-765 should be done carefully to avoid accidentally entering wrong information, which could cause the application to be denied.

Make sure your application includes the required EAD Renewal documentation, which will help prove not only your identity but also your eligibility for this particular immigration benefit. You could also be required to submit copies of the documents you used when applying for your previous EAD, depending on your immigration status.

How to File EAD Renewal Documents

The address to submit Form I-765 and supporting documentation depends on your eligibility category. Pay close attention to the instructions prior to completing the form because if you submit an incomplete application package it will be returned by the U.S. Citizenship and Immigration Services (USCIS) . The easiest way to complete this form is online rather than printing it and completing it by hand. Completing Form I-765 online allows you to correct any mistakes without having to start over.

Remember that you are required to answer every question on the form even if it doesn’t apply to you. In such cases please write "none" or N/A.

Some of the supporting documentation required by the U.S. Immigration Department when renewing your work permit include photocopies of previously issued permits as well as form I-797. You may also be required to submit the approval notice you received from USCIS along with your previous permit. If you have applied for adjustment of status, you will also be required to submit a copy of the receipt notice of your application. In addition you will also need to submit two passport-sized photos taken within 30 days of filing your application.

Remember to lightly indicate your name and alien number on the back of the photos. Also remember to include a copy of the front and back of your Form I-94 - Arrival/Departure Record.

Each application must be accompanied by the appropriate filing fee of $410. Depending on your eligibility category you may also be required to pay a biometrics fee of $85. Cash payment is not acceptable; you must send the money in form of a check or money order. The check/money order should be made out to the Department of Homeland Security. Checks must be signed and dated within six months from the date you submit your application.

Some individuals could be exempt from paying fees when renewing their EAD. Those exempt are:

  • Citizens of Palau, Marshall Islands and Micronesia
  • People who have had their removal proceedings suspended
  • Those dependent on particular foreign governments
  • NATO personnel or international organizations
  • People with deferred Enforced Departure status

How to Submit the Form and Supporting Documents

To correctly submit your EAD application package you are required to include the completed form, the supporting documentation and correct filing fee to the appropriate USCIS office. It is advisable to make a copy of every document to keep for your own records. To receive email notifications and/or text messages regarding your application status, you will need to fill out Form G-1145 and attach it to the front of your application.

While EAD renewal processing time is usually completed within 90 days, it may take longer depending on the applicant's personal situation. If you take longer than anticipated to receive your renewed EAD, you should consider requesting an interim card. In such cases, you'll be required to provide the application receipt notice you received from US immigration. You can get an interim card by simply making an appointment with your local USCIS offices and presenting the relevant documentation.

Are There Exceptions?

Following the new regulations that came into effect on January 17, 2017, you could be allowed to continue working for a maximum of 180 days pending the approval of your renewal application under the following circumstances:

  • If you applied to renew your current EAD before its expiration
  • If your application falls under the same category as the previous one

To qualify, you must belong to the any of the following eligibility categories:

  • A refugee or you are an applicant whose asylum application is pending, or if you are a citizen of Micronesia or the Marshall Islands.
  • Having been granted or applied for withholding of deportation or removal or you are a TPS applicant
  • An applicant with a pending green card renewal or a pending Form I-485 - Adjustment of Status application
  • A VAWA principal beneficiary or if you are a child of a VAWA beneficiary
  • Having applied for suspension of deportation.

Even if you are able to benefit from this automatic extension you will still need to prove your work authorization to your employer . To be able to continue to work in the USA during the EAD renewal processing time, and prove your status here are some useful ideas.

Tracking your EAD

Once you submit your EAD application and it is checked for completeness, you will receive your renewed work permit via the U.S Postal Service. You can track the shipment of your card and follow its delivery via the USPS website.

I understand one should maintain H1-B status while I-485 application is pending. But if you near to 6th H1-B limit (or you are on 7th year extension), I don’t see a big advantage of extending H1-B. What are your options if your I-485 gets denied (chances are very rare) and you are on near to your 6th H1-B limit (or on 7th year extension)? You can’t file a new greencard application or you can’t change an employer on H1-B if you are on 7th year of your H1-B.  

Yes I think I should continue with the 7th year extension... I thought intially that I will save some $$$ by not filing for the same. But, now I know that would be fooolish. Thanks for help. I-190 .. hmm that was a typo ... KM

Don't understand the logic!! My previous EAD was valid until November '04 and the renewal is issued from Aug '04 to Aug 05!!! First they want you to apply in advance and then they take off few months, even before I can rest, I have to start thinking about applying for renewal in couple of months again, what a wast e of time, effort and money, when will USCIS get any sense!!!

To Joyd I assume you would have submitted G-28 when you filed 485/EAD/140 first time where you will say the lawyer represents you. When u applied renewal EAD urself, did you submit G-28 or did you represent yourself? If you did represent yourself, how does it affect 485(does the lawyer still represent you or you represent you for 485 also) Thanks

I don't think EAD renewal and who represents you on your I-485 has any significance. If your lawyer renewed your EAD then if would have to refile G-28 for your second EAD. Correct me if I am wrong.

How To Write a Cover Letter for a DACA Renewal

If you’ve already been granted Deferred Action for Childhood Arrivals (DACA) status by U.S. Citizenship and Immigration Services (USCIS), you are eligible to renew your status every two years. You’ll need to fill out Form I-821D and submit it along with other required forms and fees to renew. It’s also recommended that you prepare a simple cover letter to include with your application as well. The cover letter allows the USCIS officer to see what’s included with your application at a glance. This article explains what a DACA renewal cover letter is and the elements it should include. What Is a DACA Renewal Cover Letter?

DACA status allows eligible undocumented immigrants to receive work permits, or employment authorization documents (EADs), and 2-year renewable protection from deportation. To maintain your DACA status , you must submit a renewal application and continue to meet the following eligibility criteria:

You have previously been a DACA recipient.

It has not been more than a year since your previous DACA status expired. If your status has expired, you’ll need to submit a new DACA application instead of a renewal.

Your current DACA expiration date is not more than a year from now.

Since your first-time DACA application, you have not left the United States without receiving advance parole first.

Since your most recently approved DACA application, you have continuously resided in the United States.

You do not have a disqualifying criminal record .

You may wish to include a cover letter with your DACA renewal request. Cover letters serve as an organizational tool. These letters tell USCIS officers more about you, the status you’re applying for, and the contents of your application. A cover letter makes it easier for a USCIS officer to review your application without overlooking anything important. You can also use a cover letter as a checklist to help ensure you’ve included all the necessary application materials.

Is a Cover Letter Required for My DACA Renewal Application?

USCIS recommends, but does not require, a cover letter for your DACA renewal application. However, there are several benefits to submitting a cover letter. With a cover letter, you can bring attention to anything important or unique that you’d like USCIS to know about. DACA has strict eligibility requirements. If you think you might have a complicated case, a cover letter can help you explain your circumstances to USCIS. 

For example, you may want to address any concerns about your educational, military, or criminal history, if applicable. If you have had any brief periods of absence from the United States for humanitarian reasons, you can also take this opportunity to explain why you still meet the continuous residency requirement for DACA status. 

You can also use the cover letter to outline the contents of your application package. Listing your application contents can be useful to the USCIS officer reviewing your paperwork.

What Should My DACA Renewal Cover Letter Include?

If you submit a cover letter with your application, be sure to include the following:

The USCIS lockbox address to which you’re sending your application

The date you wrote your letter

An appropriate subject (re:) line

A short introductory paragraph to describe the contents of your letter and package

An ordered list of the content in your application package

A closing paragraph, your signature, and your printed name

You’ll need to submit several supporting documents with your application, including:

An acceptable photo identification (ID). This may include the following:

Birth certificate

U.S. military ID

U.S. government immigration documents with your name and photo on it

Your learner’s permit or non-driver ID

Two passport photos

Form I-765 , the Application for Employment Authorization

Form I-765WS , the Application for Employment Authorization Worksheet

A copy of the front and back of your current work permit

You’ll be including the cover letter with your Form I-821D, the Consideration of Deferred Action for Childhood Arrivals. You can find the correct mailing address for Form I-821D, your supporting documents, and your cover letter from USCIS.

You’ll need to pay a $495 filing fee to renew your status. You can pay the fee with a money order or a credit card. You should make any money orders payable to the DHS by writing out “U.S. Department of Homeland Security.” To pay by credit card, you must file Form G-1450 with your application.

Tips for Writing Your DACA Renewal Cover Letter

When writing your cover letter, write clearly and concisely. You should try to type your letter on a computer if possible. Typing your letter will make it easier for a USCIS official to read and understand. Be sure to use spell check to review your spelling and grammar and to proofread your letter.

You should not staple any of your application materials. If you want to keep certain documents together, use paper clips instead. Be sure to mail your application package as certified mail.

Automatic Employment Authorization Document (EAD) Extension

ALERT : In May 2022, USCIS announced a temporary final rule that increased the automatic extension period for employment authorization and EADs available to certain EAD renewal applicants to up to 540 days. As announced in 2022, beginning Oct. 27, 2023, automatic extensions of employment authorization and EAD validity will revert to the original up to 180-day period for those eligible applicants who timely file Form I-765 renewal applications. This change is not retroactive; all previous up to 540-day automatic extensions will remain in place. For individuals who received an increased automatic extension under this rule, the automatic extension generally will end when they receive a final decision on their renewal application or the end of the up to 540-day period, whichever comes earlier. 

Certain renewal applicants who have filed Form I-765, Application for Employment Authorization, qualify for an automatic extension of their expiring employment authorization and/or EADs while their application is pending. You qualify for this extension if you:

  • Properly filed Form I-765 for a renewal of your employment authorization and/or EAD before your current EAD expired, and
  • Your renewal application is under a category that is eligible for an automatic extension (see the list of categories below); and
  • The Category on your current EAD matches the “Class Requested” listed on your Form I-797C Notice of Action, Receipt Notice. (Note: If you are a Temporary Protected Status (TPS) beneficiary or pending applicant, your EAD and this Notice must contain either the A12 or C19 category, but the categories do not need to match each other. In addition, for H-4, E, and L-2 dependent spouses, an unexpired Form I-94 indicating H-4, E, or L-2 nonimmigrant status (including E-1S, E-2S, E-3S, and L-2S class of admission codes) must accompany Form I-797C when presenting proof of employment authorization to an employer for Form I-9, Employment Eligibility Verification, purposes).

Proof of an Automatic Extension

The automatic extension period is provided to certain renewal applicants to help prevent gaps in employment authorization and documentation.

To present acceptable proof of the automatic extension of employment authorization and/or EAD validity, you can show your Form I-797C receipt notice that refers to the 180-day extension, along with your qualifying EAD (and also your unexpired Form I-94, if you are an H-4, E, or L-2 dependent spouse, including E-1S, E-2S, E-3S and L-2S class of admission codes). This document combination is also sufficient proof of an up to 540-day automatic extension under the May 2022 temporary final rule, counting from the expiration date on your current EAD.  

If you filed a Form I-765 renewal application on or after May 4, 2022, and before Oct. 27, 2023, you may have received a Form I-797C Notice of Action receipt notice that has information regarding the up to 540-day automatic extension. If you were eligible for the automatic extension, this receipt notice, together with your expired EAD (and your unexpired Form I-94, if you are an H-4, E, or L-2 dependent spouse, including E-1S, E-2S, E-3S and L-2S class of admission codes) will serve as acceptable proof of employment authorization and/or EAD validity during the up to 540-day automatic extension period.

If you were eligible for the temporary increase of the automatic extension, but you filed before May 4, 2022, you can determine whether there is any automatic extension time remaining by counting  540 days from the expiration date stated on the front of the EAD. (If you are an H-4, E, or L-2 dependent spouse, including E-1S, E-2S, E-3S and L-2S class of admission codes, count up to either 540 days or the expiration date on Form I-94, whichever is earlier.) Employers should complete Form I-9 using the same guidance applicable to those who present a Form I-797C Notice of Action receipt notice indicating that the Form I-765 renewal application was filed before May 4, 2022, and that states the normal 180-day automatic extension period.

An individual’s automatic extension period may terminate prior to the maximum period either automatically when USCIS issues a denial of the applicant’s Form I-765 renewal application or upon notice.

The following employment eligible categories are eligible for an automatic extension:
