The desperation of the homicidal patient:

Last Resort is a 5th season episode of House which first aired on November 25, 2008. A man willing to kill – or die – for a diagnosis takes House, Thirteen, and several patients from the hospital waiting room hostage in Cuddy's office. With one person shot and other patients needing medical attention, Thirteen agrees to be used as a guinea pig by the patient to prevent him from being sedated by the medications they send in to treat him. With the SWAT team closing in, House is determined to end the standoff the only way he knows how: by coming up with the right diagnosis. However, Thirteen's willingness to risk her own life makes House wonder if her reckless streak may turn fatal as each additional injection brings her kidneys closer to failure.

Many previous episodes of House featured patients that reflect a part of him, but what makes this one particularly dangerous is that the patient reflect's House callous disregard in his search for the truth, even if it means putting someone's life at risk. It's especially made clear considering the patient doesn't give a real backstory or reason why he's pushed this far, but is simply desperate to know the truth. The fact that House actually returns the gun to the man in order to keep on the search shows just how alike they are in regards to the truth, no matter who might get hurt in the process.

The episode also continues the character development of Thirteen regarding how she deals with her Huntington's. Not caring about her life and living such a risky way causes her to not even bother with accepting Foreman's offer to be in a Huntington's drug trial, refusing to accept even the slightest chance of possible recovery. But when it comes down to it with a literally gun to her head, she admits she truthfully does not want to die.

This episode finished 10th in Facebook's poll of the best episodes of the series conducted in April 2012.

A migraine patient is trying to get Thirteen to rush him through the clinic . Foreman comes in and asks Thirteen if she wants to participate in a Huntington's drug trial. She says she's not interested, and says she's not taking any treatment for her condition and brushes him off.

Another patient comes into Cuddy 's office and finds House . He tells him to get lost. However, a few minutes later, the patient comes in with a gun and hostages, mainly consisting of clinic patients but also including a nurse and Thirteen and demands that the best doctor in the hospital come and tell him what's wrong with him. House asks him, "What seems to be the problem?"

The patient with the gun starts barricading himself in Cuddy's office. House asks him not to barricade the bathroom, pointing out that many of the hostages are sick patients and doing so would likely cause some problems, but the patient ignores him. The patient starts talking about how many doctors he's seen, how he can't breathe, how tired he is, his insomnia , his rashes and his heart palpitations . He shoves his medical records into House's hands. The patient then grabs House's cane and tosses it aside.

A SWAT team arrives at the hospital. House examines the patient. He correctly guesses the patient's medical history without looking at it: all the tests are normal. The phone rings, but the patient won't answer it. The patient is having shortness of breath and a sharp pain when he inhales. House asks the hostages if they have a match. Thirteen moves to look in Cuddy's desk for one, but House tells her not to touch the desk. He manages to scrounge a lighter from one of the hostages to test if the patient can blow it out. He wheezes and is unable to blow out the lighter at arm's length. House diagnoses pulmonary scleroderma , which is easy to treat.

Cuddy calls the office. House answers and asks for something to confirm the scleroderma. The patient doesn't trust a cop coming near the office and says that he wants Cuddy to deliver the drugs. House gets the drugs from Cuddy, but the patient won't let House inject him without injecting someone else first. Unfortunately, all the patients would suffer an adverse reaction given their own sicknesses. The patient tells House that the migraine-sufferer is not on painkillers because he was looking for a refill, so House chooses him. The migraine-sufferer objects, saying that Thirteen should be the one injected because she is a doctor and the gunman doesn't like doctors. House gives the migraine-sufferer the injection anyway. The test goes well and the patient (the gunman) agrees to be injected. However, right after the agreement, the migraine-sufferer keels over and the patient realizes that the drug is a sedative . The patient shoots a hostage in the leg to show House that he shouldn't screw with him.

Thirteen treats the patient who was shot. The phone in the office rings, but the patient doesn't answer. Lieutenant Bowman arrives at the hospital to lead the SWAT team. Taub , Kutner and Cameron discuss the situation, and all of a sudden get a call from House. He puts both of his teams back together. Chase doesn't want to participate, noting that the patient isn't the only sick person "in New Jersey with a pistol". Foreman starts a differential. House uses the office wall as a whiteboard as his team starts a differential diagnosis . House realizes the patient has a way out as he gives House his address. House arranges to transfer a blood sample. The patient hears police snipers outside and tells Thirteen to open the blinds, showing the snipers. He tells them to back off. House realizes that the patient's hearing must have been extremely good to hear the snipers and thinks that it is a symptom. House notes the patient has facial palsy and thinks it is postherpetic neuralgia but the test is painful and dangerous unless he actually has it. The patient agrees to the test although the treatment is safe and painless because he needs to know right away. Bowman is negotiating terms for the medication. House tells the police not to be so rigid. Cuddy agrees to do the exchange although the police thinks she has an agenda.

Cuddy gives House the drugs and recovers the unconscious patient and the gunshot victim. The patient wants House to inject someone else, but the drug causes nerve and muscle damage. Thirteen agrees to be injected to save the rest of the patients. House tells Thirteen how stupid she is being - the drug is bad for Huntington's patients. Thirteen collapses in pain. House is trying to figure out the patient and asks him why a diagnosis is so important. The patient reacts in pain to the injection as well.

Taub and Kutner do the environmental scan . They notice that the patient must have known that he wasn't going back to his home, as he has laid out everything the doctors would need for them. Kutner notices that the patient has large unpaid medical bills and he and Taub get into a conversation about sick people being in debt because of hospital bills.

Foreman and Cameron can't find any problem with the blood tests , ruling out everything except a heart problem and cancer . Thirteen notices a problem with the patient's jugular vein . House checks the patient's pulse - its up to 160 . House starts a carotid artery massage to slow his heart. Thirteen wants to get a drug to slow down his heart, and the patient agrees to give her thirty seconds, but only after pointing the gun at the hostage who gave him the lighter so that Thirteen understands that if she doesn't come back, he will kill the boy. After running outside, Thirteen freezes when she sees police officers. Back in the room, House speculates that Thirteen won't come back. The nurse disagrees since if Thirteen doesn't come back, the patient will shoot the boy. House criticizes her, implicitly claiming that no one thinks that others' lives are more important than their own. House appears to be proven wrong when it seems that Thirteen will not be coming back and the patient acts as if he's about to shoot the boy, but the nurse yells for the patient to shoot her instead. However, at the last second, she decides she does not want to die, proving House right. Thirteen soon rushes back in, and no one is shot.

The patient once again asks that someone else be injected with the drug first. However, the drug slows the heart rate, and slowing the heart rate of someone who already has a normal heart rate is dangerous. House objects to this, but Thirteen voluntarily injects herself and passes out with a dangerously low heart rate . House injects the patient and his heartbeat returns to normal. House notices that the patient is only sweating on one side of his face, indicating that it's probably lung cancer.

Thirteen's heart rate continues to fall. House orders the nurse and the boy to help her up to raise her heart rate. House calls Wilson for a way to confirm a cancer diagnosis. House then tells the patient to spit on the floor. The patient coughs, showing that his mouth is dry. Wilson thinks it's a tumor that has metastasized . The only way to confirm is an X-ray. The patient wants to trade hostages for an X-ray.

The patient lets some of the hostages go and bundles five of the remaining hostages together around him and they start off towards radiology . House still wants to know why the patient is taking such steps. The patient says he just wants an answer.

They get to radiology. House goes to get the computer monitor as the patient gets in the scanning machine, threatening to shoot if anyone moves. House thinks there must be a deeper reason why the patient has gone to such extreme lengths, but the patient denies it, saying that he would rather know the truth and be rotting in a jail cell than not know it. This seems to resonate with House. After the CT scan , House writes something down on a notepad, hands the notepad to one of the hostages and tells the patient that if he wants the answer, he'll have to give him the gun first. Then he turns about the results of the scan and asks Thirteen what she sees. She replies that it's a starburst caused by the gun he was holding during the scan, obscuring the CT results. The hostage turns the notepad around and it says "starburst" on it. This proves that Thirteen wasn't just making up what she was saying as a way to get the gun from the patient. The patient finally gives up the gun and two more hostages leave. House, Thirteen, and the boy who gave up the lighter stay with the patient. House asks the boy why he stayed. The boy says he's curious and that it was probably safe now that the patient has given up his gun. Unfortunately, even after the gun is removed from the scanner, the scan can't find a tumor. House admits that he's stumped. The patient resigns himself to House's failure. However, House gives him back the gun, surprising everybody.

The patient seems resigned to the fact he can't be diagnosed. House tells the police that the patient overpowered him. Thirteen starts shouting at House for always having to know the answer and being so afraid to be wrong that he'd even risk the lives of others to figure out the answer. House yells back at Thirteen that he's only arrogant, that's she's the coward for trying to shorten her own life, giving her the illusion of control.

Bowman figures House has sided with the hostage taker and plans to use a concussive charge to stun everyone in the scanning room.

House calls Wilson and the team. He wants to keep up the diagnosis, but Foreman agrees with Chase and quits too. The rest of the team starts a differential. The patient shows a new symptom - partial deafness in his right ear. House thinks it might be Cushing's syndrome . The patient trades the boy for drugs. The patient still wants the drug to be used on Thirteen first. Thirteen is obviously suffering from the drugs she's taken before, but takes the needle from House and injects herself. The patient finds out Thirteen has no more than ten years left to live. House injects the patient. However, there is no improvement in his breathing. Thirteen starts having an increased heart rate and fever . House realizes her kidneys are shutting down.

House realizes Thirteen needs more medical care. However, he's wondering why the patient's kidney's are fine when he's taken the same drugs as Thirteen. House slaps the patient and realizes that he has calcium deficiency. Cameron realizes that the proton-pump inhibitors he takes as an antacid are protecting his kidneys. House realizes it must be a disease with a very long incubation period. Cameron suggests melioidosis , but it only affects people who have been to the tropics, and the patient's history doesn't indicate that. However, the patient admits he's been to Florida, which he didn't think was in "the tropics". House chastises the patient for leaving that out of his history. House orders the drug to treat it, but the police are tired of negotiating with the patient. The patient then says that he'll trade House for the drugs. House realizes that he's going to give Thirteen the drug once again and tells the patient that he'll inject the drug in himself because more drugs would kill Thirteen. The patient doesn't care, noting that since Thirteen has taken everything that he's taken, any bad reactions she has to it would more accurately reflect what would happen to him. Thirteen tells House that she'll either die from the drug or the patient will shoot her, so she'll die either way.

House leaves the room and we see the patient telling Thirteen to inject herself with the drug. Unlike the previous times where she readily injected herself, this time she is scared and admits that she doesn't want to die. The police set up the concussive charge outside the room. The patient points his gun at her, threatening her. Thirteen puts the needle closer and closer to her arm, but keeps crying that she doesn't want to die. She tells the patient, "Sometimes you just have to trust people." The patient isn't buying it. After more moments of her moving the needle closer to her arm, she exclaims that she doesn't want to die once more. The patient grows frustrated and slams the gun down and takes the drug, injecting himself, since Thirteen is obviously refusing to do so. Right at that moment, the side of the room blows up. The patient and Thirteen are both knocked to the floor. The police rush in.

House comes back into the room and goes to Thirteen. He asks Thirteen why she's still alive. Instead of telling House that she was refusing to take the drug, she tells him that he didn't make her take it.

The patient is seen walking out of the hospital with the police. House puts his hand on his chest, indicating to the patient that he should exhale to see if the treatment worked. The patient exhales normally, and smiles at House. House nods and the patient, with the police, exits the hospital.

Thirteen wakes up to find Foreman there. He tells her she will need a week of dialysis , but she should recover full kidney function. He apologizes for leaving the differential. Thirteen asks about the Huntington's drug trial.

Cuddy walks into her office and sees the damage that was done. The screen pans over the writing on the wall House did to make up for the lack of a whiteboard , the bloodstains from the shot patient, and fallen furniture. House walks in and tells Cuddy that his diagnosis was confirmed. She gets mad at him for focusing on the diagnosis instead of the danger the hospital was just in. She then suggests that she would have handled the situation better if he hadn't been in the room with the patient. House says that Cuddy thinks that their "non-relationship" caused her to screw up, remarking that there is only one change that they can make from a "non-relationship". Cuddy then asks if House wants a relationship. House says, "God no," and says that he was just trying to follow her logic. House walks away and she sits down at her desk and opens the drawer House was tampering with at the beginning of the episode. The drawer is revealed to be inserted upside-down and spills the entire contents of the drawer on the floor.

  • SWAT is the acronym for a Special Weapons And Tactics police squad. These were first developed in the 1960s to deal with situations dealing with armed criminals.

  • When deciding who would take the second round of drugs prior to the patient, House quickly touches his nose in reference to the game "Nose Goes". This is a quick observation game typically played to determine who will be the person to either go first or commit to an action all together. The last person not touching their nose is essentially "it". All of the hostages touch their nose except one, but when he refuses, Thirteen agrees to take the drugs.

Judge Cannon Runs Interference Disregarding DOJ Concerns For Witness Safety Giving Trump A Win

It's been all over the news recently that documents seized from former president Donald Trump's Mar-a-Lago resort may legally paint him into a corner. However, a recent ruling by Judge Aileen Cannon may offer a glimmer of hope for Trump's lawyers. Let's see what happened and what it means for the DOJ's case.

The Department of Justice Attempts to Shield Some Legal Filings

Last week, Jack Smith and his team met with Judge Cannon to explain why they needed to shield certain parts of their filing from Trump's defense team. According to them, there was sensitive information within the filing.

Among the sensitive information the filing contained, Smith's team contended, was the name of classified witnesses and the codename of a related FBI investigation.

<p>Unfortunately, Judge Cannon didn't see why the DOJ's lawyers blocked access to this information. She said that the grounds the DOJ cited for blocking the defense lawyers were not reasonable enough for her to redact that information from the filing.</p><p>While she did note that some of the things the DOJ mentioned did constitute a good reason for redacting or keeping filed information secret, she also stated that the DOJ didn't provide a compelling enough reason for this to happen with the filing.</p>

Not Good Enough For A Block

Unfortunately, Judge Cannon didn't see why the DOJ's lawyers blocked access to this information. She said that the grounds the DOJ cited for blocking the defense lawyers were not reasonable enough for her to redact that information from the filing.

<p>Investigators were still missing documents, so they pushed the issue further. After showing the timeline of documents they had constructed, they got a warrant to search Trump's Mar-a-Lago resort.</p><p>That search resulted in a further 100 documents bearing the "Top Secret" seal. In all, it's estimated that Trump was in possession of over three hundred top-secret documents, which he took from the presidential office after he was defeated in the last election.</p>

The Raid On the Resort

Investigators were still missing documents, so they pushed the issue further. After showing the timeline of documents they had constructed, they got a warrant to search Trump's Mar-a-Lago resort.

That search resulted in a further 100 documents bearing the "Top Secret" seal. In all, it's estimated that Trump was in possession of over three hundred top-secret documents, which he took from the presidential office after he was defeated in the last election.

Property Next Door Devaluing Your Home? 10 Ways To Handle It

Real estate depends on location. But even a nice location can have a problem.

Sometimes, when driving around suburbia on our way to visit friends or family, we take the Bay Area back roads. At times, we find ourselves lost in the elegant settings of some of the ritziest neighborhoods in Silicon Valley, those which harbor some of the more affluent postal codes in the nation. We go this route to admire and enjoy the scenery and the residences. During our meanderings, we’ve noticed that not everybody with a tony address and a big house may be in as good a shape as you would expect.

So what do you do when there’s a creepy old house located next to you or even down your street? Nobody is immune to such a blight. It looks like no matter where you live, you’re susceptible to some things that could be out of your control.

When I see places like these, I curiously think about its history and try to imagine what’s happened. It becomes particularly mysterious when a place on majestic grounds suddenly takes on an intimidating appearance. Why would such a place become abandoned? Maybe the people who live there are in financial trouble or embroiled in legal problems. Maybe they’re too old to maintain their surroundings or too old to care. They could be in foreclosure or liquidating because of a divorce. Maybe it’s a home stuck in limbo while its owners fight bureaucracy over how to rework or attend to the property.

In some parts of the SF Bay Area, this is what you’ll see. This is what an abandoned house in Atherton, California looks like:

If I ever see a house like this around where I live, I’ll be asking tough questions like:

#1 Why don’t these people sell their property? #2 Who wants to have a neighbor who can be harboring vagrants? Or criminals? #3 Can we make sure this doesn’t become a fire hazard or a health concern? #4 Will this bring down the price of my real estate?

What practical things can we do to avoid having to live beside a “problematic” house? It may not just be about old empty structures. It could also be about a house that doesn’t follow zoning standards (and may seemingly be getting away with it) and which sticks out like a sore thumb.

10 Tips To A Nuisance Free Zone

#1 Do a careful review of your neighborhood. You won’t have any problems next door if you don’t put yourself in that position in the first place! Many of these issues can be avoided altogether if you check out the vicinity of your home prior to committing to it. Before you buy or move into a new neighborhood, diligently check out your surroundings. Don’t rush into that contract or long term lease. I remember how our real estate agent warned us that a pretty house on a lovely block with a decent zip code shouldn’t be the only thing to consider when making such a life altering purchase involving your permanent place of residence. See if you can find out something about the neighbors you’ll have. Are these people nice or do they have loud pets or even louder motorbikes, tools or other equipment that go off in the middle of the night?

#2 Live in a community that provides its own services for a fee. This may not be something many people would prefer, as you’d be subject to a monthly outlay this way. But if you want to make sure you live in a well maintained community, go for one with a Homeowner’s Association (HOA) that enforces rules and standards over its homes, at least from the outside.

#3 Live in a neighborhood with stringent regulations about how homes should be maintained. As in the case of HOA communities, by choosing to live in a planned community or one with stricter zoning laws surrounding the maintenance of the homes in it, you may protect yourself from some issues that would plague others in more unregulated locations.

#4 If you’ve got a problem, find out information about the property in question. Say it’s too late and you’ve already moved into your dream home only to realize there’s something amiss nearby. What then? You can either live with it, or understand what’s going on. Find out a bit about the property, especially if it’s abandoned and growing weeds. It may pay to know who’s behind the eyesore: it’s a first step to addressing this issue. A service such as the once highly hyped but now defunct RottenNeighbor.com could be helpful.

#5 Communicate with your neighbor. If your neighbor’s actually on the site and appears harmless, then striking up a conversation with them may reveal facts that can either appease you or aggravate you further. Again, it could be the first step to action. Unfortunately, it could also be dicey to ask them to get their act together in so many words. If you’re going to try, you could at least be as diplomatic as possible as I found that a pleasant approach gets much more traction than a negative or threatening one.

#6 Get other neighbors involved. This can be handled several ways: attend town hall meetings, village or neighborhood get togethers that allow the airing of this type of problem. Zoning issues and other conflicts are typically brought up in forums like this. On the other hand, you could hold a friendly neighborhood barbecue and pick the minds of everyone who attends. Someone may have the inside scoop on the problem.

#7 Form and join a neighborhood watch group. I know this could be merely a band-aid to address deeper issues but it allows for an organized group to keep an eye on their community and especially on certain locations that may be vulnerable to unwanted visitors. It could help with preventing drifters or worse — criminals — from loitering around areas of concern.

#8 File a formal complaint to the zoning board or inspections department of the community, county or city you live in. As one of your final options, you can declare a problem house a public nuisance. I’ve seen this work pretty well in the past, with a fair measure of success. Be patient, since it does take some time for investigations to be handled.

#9 Contact your fire marshall, board of health or other authorities who may be able to assist your case. If there is a potential health hazard around your area, this could trigger quicker resolutions once it is reported. Capture the evidence and bring it up to the appropriate personnel.

#10 Move. As your true last resort, consider selling your house and moving elsewhere. However, depending on the size of your quandary or how near you are to the property (or properties) of contempt, your home’s value can be sorely affected. So taking this step is a big one with potential financial consequences. I’d consider this a desperate measure. Now if you’re renting, life will be so much easier for you as moving will be the easiest way out!

If you do happen to have this kind of house up your street, what would you do? As a kid, I’d be conjuring scary stories about it with my friends while watching more adventurous types gingerly explore its perimeter. As an adult, I’d be thinking about the bottom line and what this is doing to real estate property values. That and praying that the empty house gets sold really quickly!

Update: Well, some prayers must’ve been answered. That old house in Atherton, CA that stood empty for at least a year is no longer “abandoned”. It has been razed to the ground and is now for sale as an empty lot. Their neighbors may now rejoice.

you can also get your community together to get the town council to pass property ordinances for maintaining houses. that is what happened in my parents’ neighborhood (non-gated, non-planned community).

Keep in mind that HOA’s usually charge fees. So they may not be the most cost effective way to do this. Most cities though have ordinances against this sort of thing. Go to your local city clerk and file a complaint. Then show up at the planning commission meeting and make yourself heard.

We often forget how much impact city government has on us but for day to day stuff like this, it can really help resolve problems.

I’ve always tried to buy the ugly/abandoned house down the street. Done this about 4 times and made a profit at it.

Someone just told me they wouldn’t bother their neighbor no matter how problematic their home happens to be. I’d like to ask — when does a derelict home or seemingly unoccupied and ill-maintained piece of property stop becoming none of your business and start becoming a neighborhood problem?

The point is that you can do something to help resolve things as has also been pointed out here in the comments.

I have one point to raise here after reading this article: People, as a general rule, do not have the outgoing nature and/or tact to just meet their neighbor and find out for themselves what’s going on. I had a recent example where a decrepit house near mine was the constant source of squabble among the naighbors. Everyone was quick to comdemn and provide their theories on why it become so dilapidated, but I had a feeling no one had ever gone to the house to meet the owner/tenant.

Upon knocking, I found a sweet, kindly old woman who was barely “spirited” enough to make it from bed to the breakfast table. She had no heirs, no family, no one to take care of her yard, and did not make enough money to hire all the help she needed.

Once I spread this word to the neighborhood, several (but not all…) volunteered to help care for this woman as they could offer help, the house got spruced up, the woman has been eternally grateful and alleviated her from the shame she felt as an otherwise kind and proper elderly woman, who simply did not have the resources to care for her home any longer.

Just a friendly reminder that just because someone’s house is ugly on the outside, doesn’t mean it’s ugly on the inside. Lets all remember that there’s a human being there before we start making lists of tactics to protec property values indiscriminately.

Aaron, Your points are well taken. Definitely, we don’t want to have any kind of witch hunt going on, especially when there are people who are sincerely in challenging straits living in these homes. This is not to condone any form of neighborhood lynching based on appearance alone.

I realize that the tone of this post may be misunderstood and for that, I apologize. However, I have had the negative experience of having to deal with *extremely* difficult and unreasonable neighbors in the past and this article was just a way to explain these sort of circumstances than can befall anyone when they settle into a new neighborhood.

If I had nice, sweet neighbors in need, I will always be sensitive to their situation and would help out in any way I can. Good neighbors are a gem to live with.

Great article with good information and some great comments. Just goes to show that we need to be careful jumping to conclusions before we are in full possession of the facts. It’s articles and comments like this that makes the internet and blogging such a great resource.

I think people have too much time on their hands if this is something they find important. If there are drug addicts hanging out, call the cops. Otherwise, get down to the homeless shelter and start serving up the soup. I guarantee you won’t have the time or energy to care about such trivial matters. I saw a segment on the news regarding this topic not long ago. A man was living in a car on someone’s property. All i kept thinking was “thank goodness he has a friend who cares. he might get killed on the streets.” I think most Americans have skewed priorities because they live in relative affluence. When you look outside the bubble of your cozy life, you just stop caring about aesthetics and materialism.

@Catherine, How this kind of property issue should be dealt with would depend on the root causes. I completely agree with you that compassion should not take the backseat to other concerns, and that too many folks are caught up on their bank account balance. I brought up the topic though, because I’ve seen epic battles on matters like this — in some cases, the stories are very unfortunate, with families losing homes due to foreclosure and unemployment. There are also situations where mental issues come into play, causing the lack of maintenance of a home (e.g. hoarding). But this article was meant to discuss those cases where you may not be so comfortable about what’s happening to your neighborhood. There have been unfortunate reports of whole areas being swallowed up by foreclosure and taken over by criminal elements and many people become frightened by changes they are seeing. Can they still get their old neighborhood back?

The points here aren’t applicable to all abandonment cases, so we should use discretion when making complaints. For instance, I knew of a case where a family’s home got subdued by toxic mold and ended up with a biohazard sign on it. Their neighbors took in the family while they worked on getting their new housing requirements squared away. In a way, a single home’s problem becomes the problem of the community, and it’s in everyone’s best interest to work together to help out where they can.

John Smith, the CEO of ABC Company is employed with a package of a multimillion dollar salary, stock options and numerous perks. He is charged with the responsibility of increasing the profitability of the ABC Company.

Mr. Smith is greedy as he wants to make more money as well for himself. He devises a plan to make a huge profit for his company. He purchases another company and incorporates it into the ABC Company The plan he devises works for a few years and everyone is happy then several years later, Mr. Smith’s plan starts to backfire and the ABC Company begins to have huge losses.

Question: Who is responsible for the lack of Mr. Smith’s unethical behavior as it effects the ABC Company?

1. Is Mr. Smith responsible? 2. Is the ABC company responsible? 3. Or should John Q. Public be responsible? Ding, Ding, Ding

Let’s suppose this same John Smith is the CEO of Bank of America and he sees a way to increase the bank’s bottom line. John Smith purchases Country Wide Home Loans/Mortgage to increase profitability for Bank of America and in the bargain increases his own bottom line. Bank of America experiences huge profits then the unthinkable happens. The mortgage industry falls apart as Bank of America/Countrywide knowingly issued many bad loans based on the instant gratification of huge profits. Once again, who is responsible for Mr. Smith’s poor business decision?

This is exactly what happened to the homeowner that lives next door to a Bank of America foreclosed property. The homeowner has watched in horror as Bank of America has failed to maintained these foreclosed homes, have witnessed criminal activity enter their neighborhood due to foreclosed homes, and have seen damage to their property due to the encroachment of unmaintained foreclosed properties. The homeowner has seen his/her property value plummet as Bank of America continues to rape the marketplace and project the ways of their errors upon the unsuspecting property owner next door to the latest foreclosure all in the name of corporate greed. Bank of America made huge profits from their deceptive behavior and we as homeowners should not be responsible for their loss. We need a remedy for this outrageous behavior. Bank of America should not be allowed to profit on another’s loss.

Ive been sick with Ecoli since March of this year. The root problem is the cities creek/stream/drainage that sits right next to my yard along my entire side of house just 15 feet away. There’s also an overgrown lot on the other side 4 feet away from my home. After calling the city for over a year time after time, I called the mayor and she dropped by my home. 2 days later they somewhat cleaned the creek out but didn’t spray for bugs/insects. The lot hasn’t been touched. What should I do? I’m very sick of the gnats and bugs inside my home!! Please someone — can you help me with regards to what to do next. I’m sick of being sick…

I lived here from December 2013 to October 2014, and they were not friendly. They would constantly call my dad when there were issues. The only good things are the rent price and location near jack in the box. I was stuck with at&t because Comcast couldn't access the gated community. The worst part was this nasty neighbor who repeatedly called the police on me for watching TV at a reasonable volume. Avoid.

One of my less enjoyable apartment experiences. At first, it seemed great. The price was lower than similar units, it was right next to a Jack in the Box, and my neighbors had a nice dog. But then the noise complaints started, which eventually led to unwarranted police calls. A condescending officer insisted I use headphones so it wouldn't happen again. The worst part, and why this company gets a poor overall review, is that they constantly contacted my dad instead of me regarding their concerns.

This was the cheapest place I could find for my BF and me to live and I believe we got lucky! I really enjoyed my time here and would recommend this place to anyone who is just looking for a basic living space. This is certainly not a luxury studio. No dishwasher, microwave, air conditioning, or in-unit laundry. The units are not attractive. Cabinets were painted white and it seemed like the paint never dried down so everything was always kind of tacky to touch. Unfinished wood in some areas. Dirty carpet... But no actual problems. We never had any kind of bug issues. I must have seen a total of five spiders/silverfish in my unit in a greater than one year time period. The pest control here seemed GREAT. Water shut off only occurred once or twice. We never had any packages stolen, even though they would sometimes just be left right in front of the door. Any maintenance issues we had were resolved very promptly when communicating issues to management by email. Lejla, the management person, seemed very sweet and honest but was disorganized. I would highly recommend always contacting her by email to have evidence of communication. One parking spot per unit, but street parking was never hard to find. The complex is located right across from residential housing, so it's easy to find parking inside the neighborhood. It felt very safe here. But you definitely need to block the windows with a piece of wood to lock the window because I once locked myself out of my apartment and it took about 2 minutes for me to break into my unit. Walking distance to many Korean food stores!!!

Moving out review: I believe this apartment is one of the cheapest in the area. (My rent was $1595) However, you have to pay for all your utilities (Conservice $100, PG&E (gas) $5, Santa Clara Municipal utilities: $30) The apartment is located in Santa Clara's Korean town. Lots of expensive Korean places to eat at. If you are poor like me, go to Lawrence Food Court. You can get a full meal: Teriyaki chicken, soup, rice and salad for $10. The apartment is 15 minutes to Cupertino, Valley Fair, North San Jose. Very convenient! They have coin laundry on site, $1.75 to wash, $1.50 to dry. Sometimes the machines break down so you waste your quarter (pissed me off so much). Sometimes people open your machine and if they don't press START on the dryer again the timer goes down but it doesn't dry (piss me of again). There are 3 washers and 3 dryers. They have a big gated parking lot. You will have to give them $50 for a deposit for the remote. They also rent 1/3 of the parking lot for RVs. I really don't know why they did this. Each unit is designated to only 1 parking space. All other cars have to park on the street. Street parking is iffy. Some days there's so much parking, other days not so much. I think this is because there is a auto repair shop down the street. They use the street parking to park all their dang broken-to-be-fixed cars. Other than that, I actually really enjoyed living here, very quiet and peaceful. I didn't know my neighbors but if you see anyone they are usually really friendly and would say hello. I once had a package left out over the weekend for 3 days and no one stole it! I was very surprised. They also have individual mail slots that lock up for each unit. If you have a big package you would get a key to unlock to get your package. If it is too big you have to go to USPS which is only an 8-minute drive down on Kiely Boulevard. Management is responsive to maintenance request and would fix it in 1-3 days. The apartment manager's name is Lejla and she is wonderful. The units are okay. I live on the bottom floor and you can hear the foots steps, flushing, TV, music but if you are focused on something else you tend to not hear it. The walls are thin and you can hear people walking by your window. You also need your own light for the bedroom/living room area. The unit is 386 Square feet. Management provides you a fridge and electric stove. Each unit has 2 large closets and a bathroom. They also have a swimming pool. I believe they do clean it very often but people don't really use it. They also recently repainted the apartment and got new windows. The place looks a lot nicer than it did the year before. Overall, this place is better than what you picked as your last resort.

I moved out of this place in July 2016, so it's been a while, but I moved in September 2014 so I almost lived here for two years. I think this place is pretty decent, but there are definite pros and cons, just like with any apartment complex. One thing I remember the most about living here: smells traveled terribly through the vents (I suppose), forcing us to deal with pungent foods people were cooking. Our elderly neighbor loved cooking this particular dish (no idea what it was) probably once a week and it took over a day to air out our place. Yikes. Not a huge issue though if you're not sensitive to smells (my boyfriend is). The cabinetry in this apartment is super old and I cut myself multiple times on nails that were just sticking out on the inside of cabinets and drawers. Literally gushed blood a few times. Also- there was barely any cabinet space in the kitchen. If you love cooking, this kitchen will probably not be able to fit all of your stuff unless you get creative. (We purchased a shelving unit to stick in the corner of the kitchen for added food space.) Sadly I hated cooking in this apartment due to the lack of counter space. Like actually hated. So I barely cooked while we lived here. We did have a lot of space for storage in the two closets- these were super nice! Maintenance was super nice, but it changed a couple of times. It used to be an older gentleman and he would always say hi and was pleasant. Then it changed and I never saw maintenance being done ever, but somehow it was getting done, so I'm not sure what the deal was there. I think they were purchased by another company. Speaking of which, they changed management like 3 or 4 times while we lived there. Keep in mind there was no garbage disposal and no dishwasher in the units. I thought I'd be fine with this, well, I actually hated it. Some people are down with doing the dishes- I hate them. Personal preference. This was obviously another factor in my hatred of cooking during this time of living here. There's also no washer/dryer in the units, which I was actually okay with. It does suck to lug your laundry down the stairs if you have a large load to do though. Not only that but the laundry is coin operated, which honestly sucks so bad. I didn't think I'd hate it but you have to make sure you go get rolls of quarters every so often or you'd be out of luck. There were also only three washers and three dryers which was definitely not enough, and they were down for maintenance quite often. I do remember coming down a few times to find my clothes were still wet in the dryer because someone had opened the dryer door and didn't press start again. Honestly- who does that?? Parking was nice for me because I parked in the lot. I never had an issue with parking at all here. People were all pretty considerate and the parking spots were big enough. Also nice that it was a gated lot. My boyfriend parked on the street but not on Pomeroy- on the street perpendicular to Pomeroy and parallel to El Camino. I can't remember the name of that residential street at the moment but there was always plenty of parking there for him and it took a minute or so to walk over there. Noise really wasn't too bad here. Sometimes we'd hear the soft thumping of electronic music but it was never so loud it disturbed us, and it was never at ridiculous times. The windows (while closed) let a lot of noise in, oddly. When people walked past your window/door it sounded like they were in your apartment. I didn't have any noise issues with people next to us. They were fairly quiet. Honestly, a lot of the people here kept to themselves which can be good and bad. It was respectful and polite but also a little isolating. People seemed to say hello if you bump into them around the complex, which I think is nice. I don't need to have a convo, but can we at least address our neighbors' presence?? (Can you tell that that's an issue in my current apartment situation?) All in all, this was my first apartment in California. It wasn't horrible. It wasn't GREAT. It was definitely small (especially for two people- but we did it) but it was affordable at the time. We ended up moving to a bigger apartment in Campbell and were happier there, but I think this place is a good option for people looking for affordability and don't mind a tight space or just need to make it work for now. There's a lot of fast food around. Like a lot. But there's also a lot of Korean places around that were really good! I have to say it was convenient to be located between Lawrence (closer to Lawrence) and San Tomas expressways. I also did feel pretty safe here, which I think counts for something.

Pros: Great location, it is quiet, enough parking space, Maintenance is somewhat on time. Good management though the office only open 8 hours per week. Cons: It is a very old style apartment; the studio is very small. Pool is very small. When you move out, they will deduct almost all your deposit, for whatever reason. For this price, you may got better choice.

You get what you pay for, and for the price of $1480/month, it's fine. The walls are definitely thin, but the complex is maintained well and maintenance is performed promptly most of the time. I've had some very minor problems that were not fixed, such as drill holes from smoke alarm replacement, but the major ones always get fixed in a reasonable timeframe.

How Congress Could Bypass Republican Opposition to Funding Ukraine

Lawmakers in the House may resort to an arcane procedural move to force action on a foreign aid bill that Speaker Johnson has suggested he would not put to a vote.

Just after dawn on Tuesday, the Senate passed a $95 billion national security package with aid to Ukraine and Israel, setting up a showdown with the House, where Speaker Mike Johnson suggested he would not bring it up for a vote.

The bill passed the Senate 70 to 29, with 22 Senate Republicans breaking with their party and joining Democrats in pushing it through. But in the Republican-led House, right-wing opposition, fueled by former President Donald J. Trump, poses a steeper challenge.

Many hard-right Republicans have consistently voted against aiding Ukraine, and threatened to oust Mr. Johnson, Republican of Louisiana, if he brought up legislation to do so.

In a statement on Monday night in the hours before the bill passed the Senate, Mr. Johnson said the House would “continue to work its own will” on national security and border policies, which Republicans had insisted be a part of the foreign aid package, before killing a bipartisan deal to address them.

That may mean that the bill’s only path through the House is for a bipartisan group of lawmakers to use an obscure maneuver known as a discharge petition to force action on it.

Here’s how it would work.

A majority of the House demands action.

A discharge petition is a demand signed by 218 members of the House — a majority of the body — to force consideration of a piece of legislation on the floor.

The leaders of the majority party in the House normally control the floor and all legislative business that receives a vote. But a discharge petition can circumvent the normal channels, forcing action on a bill that has the backing of enough members. Because neither party wants that to happen on a regular basis, it is by design an arduous and time-consuming process that has rarely seen success in recent decades.

When freshman lawmakers in the majority arrive on Capitol Hill for orientation, they are typically told by their leaders to never do two things: sign a discharge petition and vote against rules, which are procedural measures brought by party leaders that allow bills to be considered on the floor.

While there are dozens of Republicans in the House who support aiding Ukraine, it is not clear how many of them — if any — would be willing to defy party leaders and team with Democrats to try to force action.

An arduous process unfolds.

Legislation must sit in a committee for 30 legislative days — days when the House is in session — before a discharge petition may be submitted. That process can be sped along if lawmakers take a related bill that has been languishing in committee for some time and add the measure they want acted upon. For instance, during a deadlock over raising the debt ceiling in the spring, Democrats readied a broadly encompassing shell bill in committee to serve as a vehicle for a measure to lift the debt ceiling, should it be needed. (It never was, because Representative Kevin McCarthy, then the speaker, joined with Democrats to push through the debt ceiling measure over his own party’s objections.)

Sponsors of a discharge petition must gather 218 signatures, which are made public in the Congressional Record. As of Tuesday, there were 219 Republicans and 212 Democrats in the House, meaning a discharge petition on the foreign aid bill would require a bipartisan coalition. Democrats are broadly supportive of the package, as is a bloc of more mainstream and national security-minded Republicans similar to the one that helped push the legislation through the Senate .

Once the petition has 218 signatures, a seven-day waiting period kicks in. (Again, only legislative days, when the House is in session, count.) After that, any signer of the petition can declare an intention to offer the measure, and the speaker must act within two legislative days to call it up. House leaders, in the meantime, could throw up procedural roadblocks.

The majority effectively loses control of the floor.

If the effort were successful, a discharge petition would allow lawmakers to steer around Mr. Johnson and hard-right Republicans who have vowed to block action on a Ukraine aid bill — or oust the speaker for bringing one up — to force action on the floor.

Hard-right Republicans have repeatedly voted against sending military assistance to Ukraine, while even some Republican proponents of doing so insisted that the aid should not be considered without including measures to fortify the U.S. border with Mexico against an influx of unauthorized migrants. But Senate Republicans tanked a version of the bill last week that included measures to crack down on the border, which they cast as too weak and viewed as politically inconvenient for Mr. Trump.

That prompted Senator Chuck Schumer, Democrat of New York and the majority leader, to strip out the border measures and push through the foreign aid package on its own.

On Monday, Mr. Johnson was still insisting on adding border restrictions.

In a statement, he said that House Republicans “were crystal clear from the very beginning of discussions that any so-called national security supplemental legislation must recognize that national security begins at our own border.” Mr. Johnson added that “in the absence of having received any single border policy change from the Senate, the House will have to continue to work its own will on these important matters.”

Representative Marjorie Taylor Greene, the right-wing Republican of Georgia, has threatened to bring up a motion to oust Mr. Johnson from the speakership if he puts legislation to aid Ukraine on the floor. But a discharge petition would take the decision out of his hands.
